| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 26, Local Government Code, |

| 12 | 12 | | is amended by adding Section 26.048 to read as follows: |

| 13 | 13 | | Sec. 26.048. RECALL ELECTIONS IN SINGLE-MEMBER DISTRICTS. |

| 14 | 14 | | (a) This section applies to a municipality that has a single-member |
|---|
| 15 | 15 | | district form of representation for the governing body of the |
|---|
| 16 | 16 | | municipality. |
|---|
| 17 | 17 | | (b) A municipality may not adopt or enforce an ordinance or |
|---|
| 18 | 18 | | charter provision authorizing an election by the municipality at |
|---|
| 19 | 19 | | large for the recall of a member of the municipality's governing |
|---|
| 20 | 20 | | body who was elected from a single-member district. Only voters of a |
|---|
| 21 | 21 | | single-member district may vote in an election to recall a member |
|---|
| 22 | 22 | | of the governing body who was elected from the district. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect September 1, 2021. |
