| 8 | 8 | | enter into interlocal contracts for the provision of law |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 791, Government Code, is |
|---|
| 12 | 12 | | amended by adding Section 791.038 to read as follows: |
|---|
| 13 | 13 | | Sec. 791.038. CONTRACTS FOR THE PROVISION OF LAW |
|---|
| 14 | 14 | | ENFORCEMENT SERVICES IN CERTAIN MUNICIPALITIES. (a) This section |
|---|
| 15 | 15 | | applies only to: |
|---|
| 16 | 16 | | (1) a county with a population of 800,000 or more and |
|---|
| 17 | 17 | | located on the international border; and |
|---|
| 18 | 18 | | (2) a municipality located wholly in a county |
|---|
| 19 | 19 | | described by Subdivision (1). |
|---|
| 20 | 20 | | (b) A municipality that enters into an interlocal contract |
|---|
| 21 | 21 | | with a county under this chapter for the county to provide law |
|---|
| 22 | 22 | | enforcement services to the municipality may abolish its municipal |
|---|
| 23 | 23 | | police department. |
|---|
| 24 | 24 | | (c) A county that enters into an interlocal contract with a |
|---|
| 25 | 25 | | municipality under this chapter for the county to provide law |
|---|
| 26 | 26 | | enforcement services to the municipality must assign county law |
|---|
| 27 | 27 | | enforcement officers to discharge official duties in the |
|---|
| 28 | 28 | | municipality. |
|---|
| 29 | 29 | | SECTION 2. Section 791.038, Government Code, as added by |
|---|
| 30 | 30 | | this Act, applies only to a contract entered into on or after the |
|---|
| 31 | 31 | | effective date of this Act. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2021. |
