10	5		A BILL TO BE ENTITLED
11	6		AN ACT
12	7		relating to the criminal penalties for the possession of certain
13	8		tetrahydrocannabinols under the Texas Controlled Substances Act.
14	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	10		SECTION 1. Sections 481.002(5) and (6), Health and Safety
16	11		Code, are amended to read as follows:
17	12		(5) "Controlled substance" means a substance,
18	13		including a drug, an adulterant, and a dilutant, listed in
19	14		Schedules I through V or Penalty Group 1, 1-A, 2, 2-A, 2-B, 3, or 4.
20	15		The term includes the aggregate weight of any mixture, solution, or
21	16		other substance containing a controlled substance. The term does
22	17		not include hemp, as defined by Section 121.001, Agriculture Code,
23	18		or the tetrahydrocannabinols in hemp.
24	19		(6) "Controlled substance analogue" means:
25	20		(A) a substance with a chemical structure
26	21		substantially similar to the chemical structure of a controlled
27	22		substance in Schedule I or II or Penalty Group 1, 1-A, 2, [or] 2-A,
28	23		or 2-B; or
29	24		(B) a substance specifically designed to produce
30	25		an effect substantially similar to, or greater than, the effect of a
31	26		controlled substance in Schedule I or II or Penalty Group 1, 1-A, 2,
32	27		[or] 2-A, or 2-B.
33	28		SECTION 2. Section 481.103(a), Health and Safety Code, is
34	29		amended to read as follows:
35	30		(a) Penalty Group 2 consists of:
36	31		(1) any quantity of the following hallucinogenic
37	32		substances, their salts, isomers, and salts of isomers, unless
38	33		specifically excepted, if the existence of these salts, isomers,
39	34		and salts of isomers is possible within the specific chemical
40	35		designation:
41	36		5-(2-aminopropyl)benzofuran (5-APB);
42	37		6-(2-aminopropyl)benzofuran (6-APB);
43	38		5-(2-aminopropyl)-2,3-dihydrobenzofuran
44	39		(5-APDB);
45	40		6-(2-aminopropyl)-2,3-dihydrobenzofuran

217	212		(iii) by substitution in the 6-membered
218	213		ring to any extent with alkyl, alkoxy, haloalkyl, thioaklyl,
219	214		alkylenedioxy, or halide substituents; or
220	215		(iv) by substitution at the 2-position of
221	216		the tryptamine ring system with an alkyl substituent; and

292	287		SECTION 3. Subchapter D, Chapter 481, Health and Safety
293	288		Code, is amended by adding Section 481.1032 to read as follows:
294	289		Sec. 481.1032. PENALTY GROUP 2-B. (a) Penalty Group 2-B
295	290		consists of any quantity of the following substances, their salts,
296	291		isomers, and salts of isomers, unless specifically excepted, if the
297	292		existence of these salts, isomers, and salts of isomers is possible
298	293		within the specific chemical designation:
299	294		Tetrahydrocannabinols, other than marihuana, and
300	295		synthetic equivalents of the substances contained in the plant, or
301	296		in the resinous extractives of Cannabis, or synthetic substances,
302	297		derivatives, and their isomers with similar chemical structure and
303	298		pharmacological activity such as:
304	299		delta-1 cis or trans tetrahydrocannabinol, and
305	300		their optical isomers;
306	301		delta-6 cis or trans tetrahydrocannabinol, and
307	302		their optical isomers;
308	303		delta-3, 4 cis or trans tetrahydrocannabinol, and
309	304		its optical isomers; or
310	305		compounds of these structures, regardless of
311	306		numerical designation of atomic positions, since nomenclature of
312	307		these substances is not internationally standardized.
313	308		(b) For the purposes of this section, the term "isomer"
314	309		includes an optical, position, or geometric isomer.
315	310		SECTION 4. Section 481.106, Health and Safety Code, is
316	311		amended to read as follows:
317	312		Sec. 481.106. CLASSIFICATION OF CONTROLLED SUBSTANCE
318	313		ANALOGUE. For the purposes of the prosecution of an offense under
319	314		this subchapter involving the manufacture, delivery, or possession
320	315		of a controlled substance, Penalty Groups 1, 1-A, 2, [and] 2-A, and
321	316		2-B include a controlled substance analogue that:
322	317		(1) has a chemical structure substantially similar to
323	318		the chemical structure of a controlled substance listed in the
324	319		applicable penalty group; or
325	320		(2) is specifically designed to produce an effect
326	321		substantially similar to, or greater than, a controlled substance
327	322		listed in the applicable penalty group.
328	323		SECTION 5. The heading to Section 481.113, Health and
329	324		Safety Code, is amended to read as follows:
330	325		Sec. 481.113. OFFENSE: MANUFACTURE OR DELIVERY OF SUBSTANCE
331	326		IN PENALTY GROUP 2, [OR] 2-A, OR 2-B.
332	327		SECTION 6. Section 481.113(a), Health and Safety Code, is
333	328		amended to read as follows:
334	329		(a) Except as authorized by this chapter, a person commits
335	330		an offense if the person knowingly manufactures, delivers, or
336	331		possesses with intent to deliver a controlled substance listed in
337	332		Penalty Group 2, [or] 2-A, or 2-B.
338	333		SECTION 7. The heading to Section 481.1161, Health and
339	334		Safety Code, is amended to read as follows:
340	335		Sec. 481.1161. OFFENSE: POSSESSION OF SUBSTANCE IN PENALTY
341	336		GROUP 2-A OR 2-B.
342	337		SECTION 8. Section 481.1161(a), Health and Safety Code, is
343	338		amended to read as follows:
344	339		(a) Except as authorized by this chapter, a person commits
345	340		an offense if the person knowingly possesses a controlled substance
346	341		listed in Penalty Group 2-A or 2-B, unless the person obtained the
347	342		substance directly from or under a valid prescription or order of a
348	343		practitioner acting in the course of professional practice.
349	344		SECTION 9. Section 481.122(a), Health and Safety Code, is
350	345		amended to read as follows:
351	346		(a) A person commits an offense if the person knowingly
352	347		delivers a controlled substance listed in Penalty Group 1, 1-A, 2,
353	348		2-B, or 3 or knowingly delivers marihuana and the person delivers
354	349		the controlled substance or marihuana to a person:
355	350		(1) who is a child;
356	351		(2) who is enrolled in a public or private primary or
357	352		secondary school; or
358	353		(3) who the actor knows or believes intends to deliver
359	354		the controlled substance or marihuana to a person described by
360	355		Subdivision (1) or (2).
361	356		SECTION 10. Sections 551.003(11) and (12), Occupations
362	357		Code, are amended to read as follows:
363	358		(11) "Controlled substance" means a substance,
364	359		including a drug:
365	360		(A) listed in Schedule I, II, III, IV, or V, as
366	361		established by the commissioner of public health under Chapter 481,
367	362		Health and Safety Code, or in Penalty Group 1, 1-A, 2, 2-B, 3, or 4,
368	363		Chapter 481; or
369	364		(B) included in Schedule I, II, III, IV, or V of
370	365		the Comprehensive Drug Abuse Prevention and Control Act of 1970 (21
371	366		U.S.C. Section 801 et seq.).
372	367		(12) "Dangerous drug" means a drug or device that:
373	368		(A) is not included in Penalty Group 1, 2, 2-B, 3,
374	369		or 4, Chapter 481, Health and Safety Code, and is unsafe for
375	370		self-medication; or
376	371		(B) bears or is required to bear the legend:
377	372		(i) "Caution: federal law prohibits
378	373		dispensing without prescription" or "Rx only" or another legend
379	374		that complies with federal law; or
380	375		(ii) "Caution: federal law restricts this
381	376		drug to use by or on the order of a licensed veterinarian."
382	377		SECTION 11. The change in law made by this Act applies only
383	378		to an offense committed on or after the effective date of this Act.
384	379		An offense committed before the effective date of this Act is
385	380		governed by the law in effect when the offense was committed, and
386	381		the former law is continued in effect for that purpose. For purposes
387	382		of this section, an offense was committed before the effective date
388	383		of this Act if any element of the offense occurred before that date.
389	384		SECTION 12. This Act takes effect September 1, 2021.
