66 AN ACT
77 relating to prohibiting camping in certain places; creating a
88 criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 48, Penal Code, is amended by adding
1111 Section 48.05 to read as follows:
1212 Sec. 48.05. PROHIBITED CAMPING. (a) In this section:
1313 (1) "Camp" means to reside temporarily in a place,
1414 with shelter.
1515 (2) "Controlled access highway" has the meaning
1616 assigned by Section 203.001, Transportation Code.
1717 (3) "Shelter" includes a tent, a tarpaulin, a lean-to,
1818 a sleeping bag, a bedroll, blankets, or any form of shelter, other
1919 than clothing, designed to protect a person from weather conditions
2020 that threaten personal health and safety.
2121 (b) A person commits an offense if the person intentionally
2222 or knowingly camps under:
2323 (1) a controlled access highway; or
2424 (2) the frontage road of a controlled access highway.
2525 (c) An offense under this section is a Class C misdemeanor.
2626 SECTION 2. This Act takes effect September 1, 2021.
