9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 48, Penal Code, is amended by adding | |
11 | 11 | Section 48.05 to read as follows: | |
12 | 12 | Sec. 48.05. PROHIBITED CAMPING. (a) In this section: | |
13 | 13 | (1) "Camp" means to reside temporarily in a place, | |
14 | 14 | with shelter. | |
15 | 15 | (2) "Controlled access highway" has the meaning | |
16 | 16 | assigned by Section 203.001, Transportation Code. | |
17 | 17 | (3) "Shelter" includes a tent, a tarpaulin, a lean-to, | |
18 | 18 | a sleeping bag, a bedroll, blankets, or any form of shelter, other | |
19 | 19 | than clothing, designed to protect a person from weather conditions | |
20 | 20 | that threaten personal health and safety. | |
21 | 21 | (b) A person commits an offense if the person intentionally | |
22 | 22 | or knowingly camps under: | |
23 | 23 | (1) a controlled access highway; or | |
24 | 24 | (2) the frontage road of a controlled access highway. | |
25 | 25 | (c) An offense under this section is a Class C misdemeanor. | |
26 | 26 | SECTION 2. This Act takes effect September 1, 2021. |
