55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the governor's power to control the sale,
88 transportation, and use of weapons and ammunition during a declared
99 state of disaster or state of emergency.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 418.019, Government Code, is amended to
1212 read as follows:
1313 Sec. 418.019. RESTRICTED SALE AND TRANSPORTATION OF
1414 MATERIALS. The governor may suspend or limit the sale, dispensing,
1515 or transportation of alcoholic beverages, [firearms,] explosives,
1616 and combustibles.
1717 SECTION 2. Section 433.002(b), Government Code, is amended
1818 to read as follows:
1919 (b) The directive may provide for:
2020 (1) control of public and private transportation in
2121 the affected area;
2222 (2) designation of specific zones in the affected area
2323 in which, if necessary, the use and occupancy of buildings and
2424 vehicles may be controlled;
2525 (3) control of the movement of persons;
2626 (4) control of places of amusement or assembly;
2727 (5) establishment of curfews;
2828 (6) control of the sale, transportation, and use of
2929 alcoholic beverages[, weapons, and ammunition, except as provided
3030 by Section 433.0045]; and
3131 (7) control of the storage, use, and transportation of
3232 explosives or flammable materials considered dangerous to public
3333 safety.
3434 SECTION 3. This Act takes effect September 1, 2021.
