7 | 7 | | relating to the governor's power to control the sale, |

8 | 8 | | transportation, and use of weapons and ammunition during a declared |

9 | 9 | | state of disaster or state of emergency. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 418.019, Government Code, is amended to |
---|
12 | 12 | | read as follows: |
---|
13 | 13 | | Sec. 418.019. RESTRICTED SALE AND TRANSPORTATION OF |
---|
14 | 14 | | MATERIALS. The governor may suspend or limit the sale, dispensing, |
---|
15 | 15 | | or transportation of alcoholic beverages, [firearms,] explosives, |
---|
16 | 16 | | and combustibles. |
---|
17 | 17 | | SECTION 2. Section 433.002(b), Government Code, is amended |
---|
18 | 18 | | to read as follows: |
---|
19 | 19 | | (b) The directive may provide for: |
---|
20 | 20 | | (1) control of public and private transportation in |
---|
21 | 21 | | the affected area; |
---|
22 | 22 | | (2) designation of specific zones in the affected area |
---|
23 | 23 | | in which, if necessary, the use and occupancy of buildings and |
---|
24 | 24 | | vehicles may be controlled; |
---|
25 | 25 | | (3) control of the movement of persons; |
---|
26 | 26 | | (4) control of places of amusement or assembly; |
---|
27 | 27 | | (5) establishment of curfews; |
---|
28 | 28 | | (6) control of the sale, transportation, and use of |
---|
29 | 29 | | alcoholic beverages[, weapons, and ammunition, except as provided |
---|
30 | 30 | | by Section 433.0045]; and |
---|
31 | 31 | | (7) control of the storage, use, and transportation of |
---|
32 | 32 | | explosives or flammable materials considered dangerous to public |
---|
33 | 33 | | safety. |
---|
34 | 34 | | SECTION 3. This Act takes effect September 1, 2021. |
