76 AN ACT
87 relating to fiscal impact statements for legislation imposing
98 mandates on health benefit plan issuers.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Chapter 314, Government Code, is amended by
1211 adding Section 314.006 to read as follows:
1312 Sec. 314.006. FISCAL IMPACT STATEMENT FOR HEALTH BENEFIT
1413 PLAN MANDATES. (a) In this section:
1514 (1) "Enrollee" means an individual who is enrolled in
1615 a health benefit plan, including a covered dependent.
1716 (2) "Health benefit plan issuer" means an insurer,
1817 health maintenance organization, or other entity authorized to
1918 provide health benefits coverage under the laws of this state.
2019 (3) "Health care provider" means a physician or other
2120 person who is licensed, certified, or otherwise authorized to
2221 provide a health care service in this state.
2322 (b) The board shall prepare a fiscal impact statement for
2423 each bill or joint resolution that requires a health benefit plan
2524 issuer to provide new health benefits, increase payments to health
2625 care providers, or implement new contractual or administrative
2726 requirements.
2827 (c) The fiscal impact statement must estimate the effect of
2928 the bill or joint resolution on health benefit plan issuer
3029 expenditures and on premiums and other costs paid by enrollees.
3130 (d) The fiscal impact statement must be attached to the bill
3231 or joint resolution immediately following:
3332 (1) the fiscal note attached under Section 314.003; or
3433 (2) another statement attached under this chapter.
3534 SECTION 2. Section 314.006, Government Code, as added by
3635 this Act, applies only to a bill or joint resolution filed on or
3736 after the effective date of this Act.
3837 SECTION 3. This Act takes effect September 1, 2021.
