97 relating to the creation of the Harris County Municipal Utility
108 District No. 578; granting a limited power of eminent domain;
119 providing authority to issue bonds; providing authority to impose
1210 assessments, fees, and taxes.
1311 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1412 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1513 Code, is amended by adding Chapter 7914A to read as follows:
1614 CHAPTER 7914A. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 578
1715 SUBCHAPTER A. GENERAL PROVISIONS
1816 Sec. 7914A.0101. DEFINITIONS. In this chapter:
1917 (1) "Board" means the district's board of directors.
2018 (2) "Commission" means the Texas Commission on
2119 Environmental Quality.
2220 (3) "Director" means a board member.
2321 (4) "District" means the Harris County Municipal
2422 Utility District No. 578.
2523 Sec. 7914A.0102. NATURE OF DISTRICT. The district is a
2624 municipal utility district created under Section 59, Article XVI,
2725 Texas Constitution.
2826 Sec. 7914A.0103. CONFIRMATION AND DIRECTOR ELECTION
2927 REQUIRED. The temporary directors shall hold an election to
3028 confirm the creation of the district and to elect five permanent
3129 directors as provided by Section 49.102, Water Code.
3230 Sec. 7914A.0104. CONSENT OF MUNICIPALITY REQUIRED. The
3331 temporary directors may not hold an election under Section
3432 7914A.0103 until each municipality in whose corporate limits or
3533 extraterritorial jurisdiction the district is located has
3634 consented by ordinance or resolution to the creation of the
3735 district and to the inclusion of land in the district.
3836 Sec. 7914A.0105. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3937 (a) The district is created to serve a public purpose and benefit.
4038 (b) The district is created to accomplish the purposes of:
4139 (1) a municipal utility district as provided by
4240 general law and Section 59, Article XVI, Texas Constitution; and
4341 (2) Section 52, Article III, Texas Constitution, that
4442 relate to the construction, acquisition, improvement, operation,
4543 or maintenance of macadamized, graveled, or paved roads, or
4644 improvements, including storm drainage, in aid of those roads.
4745 Sec. 7914A.0106. INITIAL DISTRICT TERRITORY. (a) The
4846 district is initially composed of the territory described by
4947 Section 2 of the Act enacting this chapter.
5048 (b) The boundaries and field notes contained in Section 2 of
5149 the Act enacting this chapter form a closure. A mistake made in the
5250 field notes or in copying the field notes in the legislative process
5351 does not affect the district's:
5452 (1) organization, existence, or validity;
5553 (2) right to issue any type of bond for the purposes
5654 for which the district is created or to pay the principal of and
5755 interest on a bond;
5856 (3) right to impose a tax; or
5957 (4) legality or operation.
6058 SUBCHAPTER B. BOARD OF DIRECTORS
6159 Sec. 7914A.0201. GOVERNING BODY; TERMS. (a) The district
6260 is governed by a board of five elected directors.
6361 (b) Except as provided by Section 7914A.0202, directors
6462 serve staggered four-year terms.
6563 Sec. 7914A.0202. TEMPORARY DIRECTORS. (a) The temporary
6664 board consists of:
6765 (1) Sam Cocke;
6866 (2) Lauren Brigance;
6967 (3) Alissa Payne;
7068 (4) Christopher Townsend; and
7169 (5) Terry O'Kelley.
7270 (b) Temporary directors serve until the earlier of:
7371 (1) the date permanent directors are elected under
7472 Section 7914A.0103; or
7573 (2) the fourth anniversary of the effective date of
7674 the Act enacting this chapter.
7775 (c) If permanent directors have not been elected under
7876 Section 7914A.0103 and the terms of the temporary directors have
7977 expired, successor temporary directors shall be appointed or
8078 reappointed as provided by Subsection (d) to serve terms that
8179 expire on the earlier of:
8280 (1) the date permanent directors are elected under
8381 Section 7914A.0103; or
8482 (2) the fourth anniversary of the date of the
8583 appointment or reappointment.
8684 (d) If Subsection (c) applies, the owner or owners of a
8785 majority of the assessed value of the real property in the district
8886 may submit a petition to the commission requesting that the
8987 commission appoint as successor temporary directors the five
9088 persons named in the petition. The commission shall appoint as
9189 successor temporary directors the five persons named in the
9290 petition.
9391 SUBCHAPTER C. POWERS AND DUTIES
9492 Sec. 7914A.0301. GENERAL POWERS AND DUTIES. The district
9593 has the powers and duties necessary to accomplish the purposes for
9694 which the district is created.
9795 Sec. 7914A.0302. MUNICIPAL UTILITY DISTRICT POWERS AND
9896 DUTIES. The district has the powers and duties provided by the
9997 general law of this state, including Chapters 49 and 54, Water Code,
10098 applicable to municipal utility districts created under Section 59,
10199 Article XVI, Texas Constitution.
102100 Sec. 7914A.0303. AUTHORITY FOR ROAD PROJECTS. Under
103101 Section 52, Article III, Texas Constitution, the district may
104102 design, acquire, construct, finance, issue bonds for, improve,
105103 operate, maintain, and convey to this state, a county, or a
106104 municipality for operation and maintenance macadamized, graveled,
107105 or paved roads, or improvements, including storm drainage, in aid
108106 of those roads.
109107 Sec. 7914A.0304. ROAD STANDARDS AND REQUIREMENTS. (a) A
110108 road project must meet all applicable construction standards,
111109 zoning and subdivision requirements, and regulations of each
112- municipality in whose corporate limits the road project is located.

113112 (b) If a road project is not located in the corporate limits
114- of a municipality, the road project must meet all applicable
115- construction standards, subdivision requirements, and regulations
116- of each county in which the road project is located.
117- (c) If a road project extends across the boundary of the
118- corporate limits of a municipality, the road project must meet:
119- (1) for a segment of a road project located in a
120- municipality, the applicable construction standards, subdivision
121- requirements, and regulations of that municipality; and
122- (2) for a segment of a road project located in the
123- unincorporated area of a county, the applicable construction
124- standards, subdivision requirements, and regulations of that
125- county.
126- (d) If the state will maintain and operate the road, the
113+ or extraterritorial jurisdiction of a municipality, the road
114+ project must meet all applicable construction standards,
115+ subdivision requirements, and regulations of each county in which
116+ the road project is located.
117+ (c) If the state will maintain and operate the road, the
127118 Texas Transportation Commission must approve the plans and
128119 specifications of the road project.
129120 Sec. 7914A.0305. COMPLIANCE WITH MUNICIPAL CONSENT
130121 ORDINANCE OR RESOLUTION. The district shall comply with all
131122 applicable requirements of any ordinance or resolution that is
132123 adopted under Section 54.016 or 54.0165, Water Code, and that
133124 consents to the creation of the district or to the inclusion of land
134125 in the district.
135126 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
136127 Sec. 7914A.0401. ELECTIONS REGARDING TAXES OR BONDS. (a)
137128 The district may issue, without an election, bonds and other
138129 obligations secured by:
139130 (1) revenue other than ad valorem taxes; or
140131 (2) contract payments described by Section
141132 7914A.0403.
142133 (b) The district must hold an election in the manner
143134 provided by Chapters 49 and 54, Water Code, to obtain voter approval
144135 before the district may impose an ad valorem tax or issue bonds
145136 payable from ad valorem taxes.
146137 (c) The district may not issue bonds payable from ad valorem
147138 taxes to finance a road project unless the issuance is approved by a
148139 vote of a two-thirds majority of the district voters voting at an
149140 election held for that purpose.
150141 Sec. 7914A.0402. OPERATION AND MAINTENANCE TAX. (a) If
151142 authorized at an election held under Section 7914A.0401, the
152143 district may impose an operation and maintenance tax on taxable
153144 property in the district in accordance with Section 49.107, Water
154145 Code.
155146 (b) The board shall determine the tax rate. The rate may not
156147 exceed the rate approved at the election.
157148 Sec. 7914A.0403. CONTRACT TAXES. (a) In accordance with
158149 Section 49.108, Water Code, the district may impose a tax other than
159150 an operation and maintenance tax and use the revenue derived from
160151 the tax to make payments under a contract after the provisions of
161152 the contract have been approved by a majority of the district voters
162153 voting at an election held for that purpose.
163154 (b) A contract approved by the district voters may contain a
164155 provision stating that the contract may be modified or amended by
165156 the board without further voter approval.
166157 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
167158 Sec. 7914A.0501. AUTHORITY TO ISSUE BONDS AND OTHER
168159 OBLIGATIONS. The district may issue bonds or other obligations
169160 payable wholly or partly from ad valorem taxes, impact fees,
170161 revenue, contract payments, grants, or other district money, or any
171162 combination of those sources, to pay for any authorized district
172163 purpose.
173164 Sec. 7914A.0502. TAXES FOR BONDS. At the time the district
174165 issues bonds payable wholly or partly from ad valorem taxes, the
175166 board shall provide for the annual imposition of a continuing
176167 direct ad valorem tax, without limit as to rate or amount, while all
177168 or part of the bonds are outstanding as required and in the manner
178169 provided by Sections 54.601 and 54.602, Water Code.
179170 Sec. 7914A.0503. BONDS FOR ROAD PROJECTS. At the time of
180171 issuance, the total principal amount of bonds or other obligations
181172 issued or incurred to finance road projects and payable from ad
182173 valorem taxes may not exceed one-fourth of the assessed value of the
183174 real property in the district.
184175 SECTION 2. The Harris County Municipal Utility District No.
185176 578 initially includes all the territory contained in the following
186177 area:
187178 Being 143.34 acres of land located in the Humphrey Jackson
188179 Survey, Abstract 37, Harris County, Texas, Said 143.34 acre tract
189180 being the remainder of that certain called 175.61 acre tract,
190181 conveyed to Rampart Holding LP, by an instrument of record under
191182 File Number Y254152, of the Official Public Records of Real
192183 Property of said Harris County (H.C.O.P.R.R.P.); said 143.34 acre
193184 tract being more particularly described by metes and bounds as
194185 follows with all bearings referenced to the Texas Coordinate
195186 System, South Central Zone, NAD 83 (NA2011);
196187 BEGINNING at a 1/2-inch iron rod, found for the Northeast
197188 corner of that certain called 32.272 acre tract conveyed to
198189 Stonebridge at Newport, Inc by an instrument of record under File
199190 Number RP-2016-30087, H.C.O.P.R.R.P.; same being on the south
200191 right-of-way line of Diamondhead Boulevard (100' wide), as shown on

367358 SECTION 3. (a) The legal notice of the intention to
368359 introduce this Act, setting forth the general substance of this
369360 Act, has been published as provided by law, and the notice and a
370361 copy of this Act have been furnished to all persons, agencies,
371362 officials, or entities to which they are required to be furnished
372363 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
373364 Government Code.
374365 (b) The governor, one of the required recipients, has
375366 submitted the notice and Act to the Texas Commission on
376367 Environmental Quality.
377368 (c) The Texas Commission on Environmental Quality has filed
378369 its recommendations relating to this Act with the governor, the
379370 lieutenant governor, and the speaker of the house of
380371 representatives within the required time.
381372 (d) All requirements of the constitution and laws of this
382373 state and the rules and procedures of the legislature with respect
383374 to the notice, introduction, and passage of this Act are fulfilled
384375 and accomplished.
385376 SECTION 4. (a) If this Act does not receive a two-thirds
386377 vote of all the members elected to each house, Subchapter C, Chapter
387378 7914A, Special District Local Laws Code, as added by Section 1 of
388379 this Act, is amended by adding Section 7914A.0306 to read as
389380 follows:
390381 Sec. 7914A.0306. NO EMINENT DOMAIN POWER. The district may
391382 not exercise the power of eminent domain.
392383 (b) This section is not intended to be an expression of a
393384 legislative interpretation of the requirements of Section 17(c),
394385 Article I, Texas Constitution.
395386 SECTION 5. This Act takes effect immediately if it receives
396387 a vote of two-thirds of all the members elected to each house, as
397388 provided by Section 39, Article III, Texas Constitution. If this
398389 Act does not receive the vote necessary for immediate effect, this
399390 Act takes effect September 1, 2021.
