66 AN ACT
77 relating to the creation and administration of the On-The-Ground
88 Conservation Program by the State Soil and Water Conservation
99 Board.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 201, Agriculture Code, is amended by
1212 adding Subchapter J to read as follows:
1313 SUBCHAPTER J. ON-THE-GROUND CONSERVATION PROGRAM
1414 Sec. 201.351. DEFINITIONS. In this subchapter:
1515 (1) "Priority conservation measure" means a priority
1616 soil and water conservation land improvement measure designated
1717 under Section 201.355.
1818 (2) "Program" means the On-The-Ground Conservation
1919 Program.
2020 (3) "Soil health characteristics" means the physical,
2121 chemical, and biological characteristics of soil for optimal
2222 production, including lower bulk density, good gas exchange, lower
2323 surface temperature during growing season, high cation exchange
2424 capacity, high soil organic matter, and active soil
2525 microorganisms.
2626 Sec. 201.352. CREATION OF PROGRAM. The state board shall
2727 develop and administer the program to maximize public benefits by
2828 facilitating priority conservation measures and other soil and
2929 water conservation land improvement measures by landowners and
3030 operators in this state.
3131 Sec. 201.353. PROGRAM FUNCTIONS. (a) The state board shall
3232 provide through the program:
3333 (1) technical assistance;
3434 (2) cost-share assistance;
3535 (3) direct grants; and
3636 (4) help in obtaining technical assistance,
3737 cost-share assistance, and direct grants from other public or
3838 private sources.
3939 (b) The state board shall create rules, forms, and
4040 procedures necessary for the administration of the program.
4141 (c) The state board may:
4242 (1) obtain grants, cost-sharing assistance, or other
4343 forms of funding from other state or federal governmental entities;
4444 (2) coordinate, receive, and use gifts, grants, and
4545 donations from private sources;
4646 (3) work with qualified nonprofit organizations and
4747 universities to provide technical assistance; and
4848 (4) designate one or more conservation districts to
4949 administer the program locally.
5050 Sec. 201.354. PROGRAM COST-SHARE RATES. The state board
5151 shall establish cost-share rates for eligible soil and water
5252 conservation land improvement measures under the program.
5353 Sec. 201.355. PRIORITY CONSERVATION MEASURES. (a) The
5454 board shall designate and give priority under the program to
5555 priority conservation measures that maximize public benefits to the
5656 state. Priority conservation measures include measures that:
5757 (1) improve soil health characteristics;
5858 (2) conserve and manage water resources;
5959 (3) prevent and manage flooding;
6060 (4) control invasive and nuisance species;
6161 (5) improve resilience to weather extremes, climate
6262 variability, and natural disasters;
6363 (6) protect and enhance native habitats, including the
6464 protection of endangered species;
6565 (7) mitigate and reduce soil erosion;
6666 (8) restore land damaged by development; and
6767 (9) sequester carbon to provide environmental
6868 benefits.
6969 (b) The state board:
7070 (1) shall establish standards and specifications for
7171 each priority conservation measure designated under this section;
7272 and
7373 (2) may consider local priorities and needs in
7474 designating a priority conservation measure under this section.
7575 Sec. 201.356. REPORT. The state board shall include
7676 information regarding the program's activities in the annual report
7777 required by Section 201.028.
7878 SECTION 2. The State Soil and Water Conservation Board is
7979 required to create and implement the On-The-Ground Conservation
8080 Program as provided by this Act only if the legislature
8181 appropriates money specifically for that purpose. If the
8282 legislature does not appropriate money specifically for that
8383 purpose, the State Soil and Water Conservation Board may, but is not
8484 required to, create and implement the On-The-Ground Conservation
8585 Program as provided by this Act using other appropriations
8686 available for that purpose.
8787 SECTION 3. This Act takes effect September 1, 2021.
