9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 16, Alcoholic Beverage Code, is amended | |
11 | 11 | by adding Section 16.13 to read as follows: | |
12 | 12 | Sec. 16.13. STATE OF DISASTER OR EMERGENCY. | |
13 | 13 | Notwithstanding any other provision of law, a winery shall be | |
14 | 14 | treated in the same manner as a restaurant for any order, | |
15 | 15 | proclamation, regulation, or directive issued by the governor or a | |
16 | 16 | local governmental body that relates to the operation of an | |
17 | 17 | alcoholic beverage establishment during a state of disaster or | |
18 | 18 | local state of disaster declared under Chapter 418, Government | |
19 | 19 | Code, or a state of emergency proclaimed under Chapter 433, | |
20 | 20 | Government Code. | |
21 | 21 | SECTION 2. This Act takes effect immediately if it receives | |
22 | 22 | a vote of two-thirds of all the members elected to each house, as | |
23 | 23 | provided by Section 39, Article III, Texas Constitution. If this | |
24 | 24 | Act does not receive the vote necessary for immediate effect, this | |
25 | 25 | Act takes effect September 1, 2021. |
