| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 39.151, Utilities Code, is amended by |
|---|
| 12 | 12 | | adding Subsections (g-2) and (g-3) to read as follows: |
|---|
| 13 | 13 | | (g-2) To qualify to serve as a member of the governing body |
|---|
| 14 | 14 | | under Subsection (g)(4), (5), (6), or (7), a person must be a |
|---|
| 15 | 15 | | resident of this state. |
|---|
| 16 | 16 | | (g-3) To maintain certification as an independent |
|---|
| 17 | 17 | | organization under this section, an organization's chief executive |
|---|
| 18 | 18 | | officer and other corporate officers must be residents of this |
|---|
| 19 | 19 | | state. |
|---|
| 20 | 20 | | SECTION 2. (a) An independent organization certified under |
|---|
| 21 | 21 | | Section 39.151, Utilities Code, by the Public Utility Commission of |
|---|
| 22 | 22 | | Texas before September 1, 2021, shall hold elections and select new |
|---|
| 23 | 23 | | members as needed to modify the organization's governing body to |
|---|
| 24 | 24 | | comply with Section 39.151, Utilities Code, as amended by this Act, |
|---|
| 25 | 25 | | as soon as practicable, but not later than September 1, 2022. |
|---|
| 26 | 26 | | (b) An independent organization certified under Section |
|---|
| 27 | 27 | | 39.151, Utilities Code, by the Public Utility Commission of Texas |
|---|
| 28 | 28 | | before September 1, 2021, shall ensure that the chief executive |
|---|
| 29 | 29 | | officer and other corporate officers of the organization are |
|---|
| 30 | 30 | | residents of this state as soon as practicable, but not later than |
|---|
| 31 | 31 | | September 1, 2022. |
|---|
| 32 | 32 | | (c) After September 1, 2022, the Public Utility Commission |
|---|
| 33 | 33 | | of Texas may decertify an independent organization whose governing |
|---|
| 34 | 34 | | body, chief executive officer, or other corporate officers do not |
|---|
| 35 | 35 | | comply with Section 39.151, Utilities Code, as amended by this Act. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect September 1, 2021. |
