55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the governing body and corporate officers of the
88 independent organization certified to manage the ERCOT power
99 region.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 39.151, Utilities Code, is amended by
1212 adding Subsections (g-2) and (g-3) to read as follows:
1313 (g-2) To qualify to serve as a member of the governing body
1414 under Subsection (g)(4), (5), (6), or (7), a person must be a
1515 resident of this state.
1616 (g-3) To maintain certification as an independent
1717 organization under this section, an organization's chief executive
1818 officer and other corporate officers must be residents of this
1919 state.
2020 SECTION 2. (a) An independent organization certified under
2121 Section 39.151, Utilities Code, by the Public Utility Commission of
2222 Texas before September 1, 2021, shall hold elections and select new
2323 members as needed to modify the organization's governing body to
2424 comply with Section 39.151, Utilities Code, as amended by this Act,
2525 as soon as practicable, but not later than September 1, 2022.
2626 (b) An independent organization certified under Section
2727 39.151, Utilities Code, by the Public Utility Commission of Texas
2828 before September 1, 2021, shall ensure that the chief executive
2929 officer and other corporate officers of the organization are
3030 residents of this state as soon as practicable, but not later than
3131 September 1, 2022.
3232 (c) After September 1, 2022, the Public Utility Commission
3333 of Texas may decertify an independent organization whose governing
3434 body, chief executive officer, or other corporate officers do not
3535 comply with Section 39.151, Utilities Code, as amended by this Act.
3636 SECTION 3. This Act takes effect September 1, 2021.
