66 AN ACT
77 relating to the provision of an emergency power source to residents
88 of certain public housing facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 392, Local Government
1111 Code, is amended by adding Section 392.068 to read as follows:
1212 Sec. 392.068. PROVISION OF EMERGENCY POWER SOURCE TO
1313 RESIDENTS OF CERTAIN FACILITIES. (a) This section applies only to
1414 a housing facility that is operated by a municipal housing
1515 authority and that:
1616 (1) has more than 100 residents, of which at least 50
1717 percent are elderly or disabled individuals; and
1818 (2) is located in a municipality with a population of
1919 more than 500,000.
2020 (b) A municipal housing authority shall ensure that each
2121 housing facility described by Subsection (a) is equipped with an
2222 operational emergency generator or comparable emergency power
2323 source that is capable of providing continuous electric utility
2424 services to the facility during severe weather events or other
2525 emergencies.
2626 SECTION 2. This Act takes effect September 1, 2021.
