9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter D, Chapter 392, Local Government | |
11 | 11 | Code, is amended by adding Section 392.068 to read as follows: | |
12 | 12 | Sec. 392.068. PROVISION OF EMERGENCY POWER SOURCE TO | |
13 | 13 | RESIDENTS OF CERTAIN FACILITIES. (a) This section applies only to | |
14 | 14 | a housing facility that is operated by a municipal housing | |
15 | 15 | authority and that: | |
16 | 16 | (1) has more than 100 residents, of which at least 50 | |
17 | 17 | percent are elderly or disabled individuals; and | |
18 | 18 | (2) is located in a municipality with a population of | |
19 | 19 | more than 500,000. | |
20 | 20 | (b) A municipal housing authority shall ensure that each | |
21 | 21 | housing facility described by Subsection (a) is equipped with an | |
22 | 22 | operational emergency generator or comparable emergency power | |
23 | 23 | source that is capable of providing continuous electric utility | |
24 | 24 | services to the facility during severe weather events or other | |
25 | 25 | emergencies. | |
26 | 26 | SECTION 2. This Act takes effect September 1, 2021. |
