11	6		AN ACT
12	7		relating to the election of certain junior college district
13	8		trustees by plurality vote.
14	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	10		SECTION 1. Section 130.082, Education Code, is amended by
16	11		amending Subsection (g) and adding Subsections (g-1) and (g-2) to
17	12		read as follows:
18	13		(g) The board shall [designate a] number [for] the positions
19	14		on [position held by each member of] the board[, from one upward] in
20	15		the [consecutive numerical] order in which the [such manner that
21	16		the lowest numbers shall be assigned to the members whose] terms of
22	17		office of the members expire [in the shortest length of time],
23	18		provided that any [such] position number designations on existing
24	19		boards under existing law on [at] the effective date of this act or
25	20		on the effective date of an amendment to this subsection shall
26	21		remain in effect. At each election candidates must [shall] be voted
27	22		upon and be elected separately for each position on the board, and
28	23		the name of each candidate must [shall] be placed on the official
29	24		ballot according to the number of the position for which the
30	25		candidate [he or she] is running. Except as provided by Subsection

52	47		desires to run. The order [location] on the ballot of the names of
53	48		candidates for each position shall be chosen by lot by the board. A
54	49		candidate shall be eligible to run for only one position at each
55	50		election.
56	51		(g-1) The board of trustees of the following junior college
57	52		districts may by resolution provide, not later than the 180th day
58	53		before the date of an election, that a candidate receiving the
59	54		highest number of votes cast for each respective position to be
60	55		filled at the election is elected:
61	56		(1) Laredo Community College District; and
62	57		(2) Southwest Texas Junior College District.
63	58		(g-2) A resolution adopted under Subsection (g-1) is
64	59		effective for subsequent elections until rescinded by a subsequent
65	60		resolution adopted not later than the 180th day before the date of
66	61		the first election to which the rescission applies.
67	62		SECTION 2. The change in law made by this Act applies only
68	63		to an election ordered on or after the effective date of this Act.
69	64		SECTION 3. This Act takes effect September 1, 2021.
