105 A BILL TO BE ENTITLED
116 AN ACT
127 relating to the election of certain junior college district
138 trustees by plurality vote.
149 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1510 SECTION 1. Section 130.082, Education Code, is amended by
1611 amending Subsection (g) and adding Subsections (g-1) and (g-2) to
1712 read as follows:
1813 (g) The board shall [designate a] number [for] the positions
1914 on [position held by each member of] the board[, from one upward] in
2015 the [consecutive numerical] order in which the [such manner that
2116 the lowest numbers shall be assigned to the members whose] terms of
2217 office of the members expire [in the shortest length of time],
2318 provided that any [such] position number designations on existing
2419 boards under existing law on [at] the effective date of this act or
2520 on the effective date of an amendment to this subsection shall

4843 earlier than the 30th day before the date of the filing deadline.

5247 desires to run. The order [location] on the ballot of the names of
5348 candidates for each position shall be chosen by lot by the board. A
5449 candidate shall be eligible to run for only one position at each
5550 election.
5651 (g-1) The board of trustees of the following junior college
5752 districts may by resolution provide, not later than the 180th day
5853 before the date of an election, that a candidate receiving the
5954 highest number of votes cast for each respective position to be
6055 filled at the election is elected:
6156 (1) Laredo Community College District; and
6257 (2) Southwest Texas Junior College District.
6358 (g-2) A resolution adopted under Subsection (g-1) is
6459 effective for subsequent elections until rescinded by a subsequent
6560 resolution adopted not later than the 180th day before the date of
6661 the first election to which the rescission applies.
6762 SECTION 2. The change in law made by this Act applies only
6863 to an election ordered on or after the effective date of this Act.
6964 SECTION 3. This Act takes effect September 1, 2021.
