55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the women who are eligible for certification as owners
88 of a historically underutilized business.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2161.001(3), Government Code, is amended
1111 to read as follows:
1212 (3) "Economically disadvantaged person" means a
1313 person who:
1414 (A) is economically disadvantaged because of the
1515 person's identification as a member of a certain group, including:
1616 (i) Black Americans;
1717 (ii) Hispanic Americans;
1818 (iii) minority women;
1919 (iv) Asian Pacific Americans;
2020 (v) Native Americans; and
2121 (vi) veterans as defined by 38 U.S.C.
2222 Section 101(2) who have suffered at least a 20 percent
2323 service-connected disability as defined by 38 U.S.C. Section
2424 101(16); and
2525 (B) has suffered the effects of discriminatory
2626 practices or other similar insidious circumstances over which the
2727 person has no control.
2828 SECTION 2. Sections 2161.061(b), (d), and (e), Government
2929 Code, are amended to read as follows:
3030 (b) As one of its certification procedures, the comptroller
3131 may:
3232 (1) approve the certification program of one or more
3333 local governments or nonprofit organizations in this state that
3434 certify historically underutilized businesses, minority business
3535 enterprises, minority women's business enterprises, or
3636 disadvantaged business enterprises under substantially the same
3737 definition, to the extent applicable, used by Section 2161.001, if
3838 the local government or nonprofit organization meets or exceeds the
3939 standards established by the comptroller; and
4040 (2) certify a business that is certified by a local
4141 government or by a nonprofit organization as a historically
4242 underutilized business under this chapter.
4343 (d) A local government or a nonprofit organization that
4444 certifies historically underutilized businesses, minority business
4545 enterprises, minority women's business enterprises, or
4646 disadvantaged business enterprises as described in Subsections (b)
4747 and (c) shall complete the certification of an applicant or provide
4848 an applicant with written justification of its certification denial
4949 within the period established by the comptroller in its rules for
5050 certification activities.
5151 (e) A local government or a nonprofit organization that
5252 certifies historically underutilized businesses under Subsection
5353 (c) or that conducts a certification program described by and
5454 approved under Subsection (b) shall make available to the public an
5555 online searchable database containing information about
5656 historically underutilized businesses, minority business
5757 enterprises, minority women's business enterprises, and
5858 disadvantaged business enterprises certified by the local
5959 government or nonprofit organization, including:
6060 (1) the name of the business;
6161 (2) the contact person or owner of the business;
6262 (3) the address and telephone number of the business;
6363 (4) the type or category of business, including
6464 relevant capabilities of the business and the North American
6565 Industry Classification System codes for the business; and
6666 (5) the expiration date of the business's
6767 certification.
6868 SECTION 3. The change in law made by this Act applies only
6969 to the certification of a business as a historically underutilized
7070 business under Chapter 2161, Government Code, occurring on or after
7171 the effective date of this Act. The certification of a business as a
7272 historically underutilized business occurring before the effective
7373 date of this Act is governed by the law in effect on the date of the
7474 certification, and the former law is continued in effect for that
7575 purpose.
7676 SECTION 4. This Act takes effect September 1, 2021.
