77 relating to rolling blackouts.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter D, Chapter 38, Utilities Code, is
1010 amended by adding Section 38.074 to read as follows:
1111 Sec. 38.074. ROLLING BLACKOUTS. The commission by rule
1212 shall require each electric utility, municipally owned utility, and
1313 electric cooperative that is subject to a rolling blackout
1414 initiated by an independent organization certified under Section
1515 39.151 to rotate customer curtailment so that no customer is
1616 subject to an outage of more than 12 hours.
1717 SECTION 2. (a) The Public Utility Commission of Texas shall
1818 conduct a study on:
1919 (1) methods to make the imposition of a rolling
2020 blackout equitable across the state; and
2121 (2) measures needed in this state to prevent the
2222 necessity of rolling blackouts.
2323 (b) Not later than September 1, 2022, the Public Utility
2424 Commission of Texas shall submit to the legislature a report on the
2525 results of the study.
2626 SECTION 3. This Act takes effect September 1, 2021.
