8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Subchapter D, Chapter 38, Utilities Code, is | |
10 | 10 | amended by adding Section 38.074 to read as follows: | |
11 | 11 | Sec. 38.074. ROLLING BLACKOUTS. The commission by rule | |
12 | 12 | shall require each electric utility, municipally owned utility, and | |
13 | 13 | electric cooperative that is subject to a rolling blackout | |
14 | 14 | initiated by an independent organization certified under Section | |
15 | 15 | 39.151 to rotate customer curtailment so that no customer is | |
16 | 16 | subject to an outage of more than 12 hours. | |
17 | 17 | SECTION 2. (a) The Public Utility Commission of Texas shall | |
18 | 18 | conduct a study on: | |
19 | 19 | (1) methods to make the imposition of a rolling | |
20 | 20 | blackout equitable across the state; and | |
21 | 21 | (2) measures needed in this state to prevent the | |
22 | 22 | necessity of rolling blackouts. | |
23 | 23 | (b) Not later than September 1, 2022, the Public Utility | |
24 | 24 | Commission of Texas shall submit to the legislature a report on the | |
25 | 25 | results of the study. | |
26 | 26 | SECTION 3. This Act takes effect September 1, 2021. |
