| 8 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 10 | | SECTION 1. Section 11.059, Education Code, is amended by |
|---|
| 10 | 11 | | adding Subsection (e) to read as follows: |
|---|
| 11 | 12 | | (e) Not later than December 31, 2026, the board of trustees |
|---|
| 12 | 13 | | may adopt a resolution changing the length of the terms of its |
|---|
| 13 | | - | trustees until the date the November election is canvassed. The |
|---|
| 14 | | - | resolution must provide for staggered terms of either three or four |
|---|
| 15 | | - | years and specify the manner in which the transition from the length |
|---|
| 16 | | - | of the former term to the modified term is made. The transition |
|---|
| 17 | | - | must begin with the first regular election for trustees that occurs |
|---|
| 18 | | - | after the board adopts the resolution, and a trustee who serves on |
|---|
| 19 | | - | the date the resolution is adopted shall serve the remainder of that |
|---|
| 20 | | - | term. This subsection expires January 1, 2032. |

|---|
| 25 | 25 | | the November uniform election date may, not later than December 31, |
|---|
| 26 | 26 | | 2026, change the date on which it holds its general election for |
|---|
| 27 | 27 | | officers to the November uniform election date. This subsection |
|---|
| 28 | 28 | | expires January 1, 2027. |

| 29 | 29 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2021. |
