| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Subchapter I, Chapter 201, Transportation Code, | |
| 12 | 12 | is amended by adding Section 201.712 to read as follows: | |
| 13 | 13 | Sec. 201.712. REIMBURSEMENT OF EXCESS COSTS INCURRED BY | |
| 14 | 14 | CERTAIN GRANT RECIPIENTS. (a) This section applies only to a grant | |
| 15 | 15 | awarded by the department for the construction of a transportation | |
| 16 | 16 | project in a county with a population of less than 25,000 or a | |
| 17 | 17 | municipality with a population of less than 15,000. | |
| 18 | 18 | (b) The department shall reimburse a grant recipient for | |
| 19 | 19 | costs incurred by the recipient that exceed the amount of the grant | |
| 20 | 20 | awarded by the department if the construction of the transportation | |
| 21 | 21 | project is managed by the department. | |
| 22 | 22 | SECTION 2. The change in law made by this Act applies only | |
| 23 | 23 | to a grant awarded by the Texas Department of Transportation on or | |
| 24 | 24 | after the effective date of this Act. A grant awarded before the | |
| 25 | 25 | effective date of this Act is governed by the law in effect on the | |
| 26 | 26 | date the award was made, and the former law is continued in effect | |
| 27 | 27 | for that purpose. | |
| 28 | 28 | SECTION 3. This Act takes effect September 1, 2021. |
