| 7 | 7 | | relating to the term of office for certain trustees of an |

| 8 | 8 | | independent school district. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 11.059, Education Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (a) and adding Subsection (e) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (a) Except as provided by Subsection (e), a [A] trustee of |
|---|
| 14 | 14 | | an independent school district serves a term of three or four years. |
|---|
| 15 | 15 | | (e) If a trustee votes in favor of making a severance |
|---|
| 16 | 16 | | payment, as defined by Section 11.201(c), to the superintendent of |
|---|
| 17 | 17 | | the school district less than one year after the trustee voted in |
|---|
| 18 | 18 | | favor of accepting or extending the superintendent's contract or |
|---|
| 19 | 19 | | increasing the superintendent's salary, the trustee must, to retain |
|---|
| 20 | 20 | | a position on the board, seek reelection at the next regularly |
|---|
| 21 | 21 | | scheduled trustee election, regardless of the time remaining on the |
|---|
| 22 | 22 | | trustee's term. The person elected at the election held under this |
|---|
| 23 | 23 | | subsection shall serve for the remainder of the trustee's term. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2021. |
