55 AN ACT
66 relating to the making of an anatomical gift.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 692A.005(b), Health and Safety Code, is
99 amended to read as follows:
1010 (b) A donor or other person authorized to make an anatomical
1111 gift under Section 692A.004 may make a gift by a donor card or other
1212 record signed by the donor or other person making the gift or by
1313 authorizing that a statement or symbol indicating the donor has
1414 made an anatomical gift be included on a donor registry. If the
1515 donor or other person is physically unable to sign a record, the
1616 record may be signed by another individual at the direction of the
1717 donor or other person and must:
1818 (1) be witnessed by at least two adults, at least one
1919 of whom is a disinterested witness, who have signed at the request
2020 of the donor or the other person, or be acknowledged before a notary
2121 public; and
2222 (2) state that the record has been signed and
2323 witnessed or acknowledged as provided in Subdivision (1).
2424 SECTION 2. Section 692A.005(e), Health and Safety Code, is
2525 added to read as follows:
2626 (e) An anatomical gift made through an online donor registry
2727 does not require any witnesses or the consent of any person. The
2828 online registration is a document of gift under this chapter and
2929 remains binding after the donor's death unless amended or revoked
3030 by the donor.
3131 SECTION 3. Section 692A.006(b), Health and Safety Code, is
3232 amended to read as follows:
3333 (b) A record signed pursuant to Subsection (a)(1)(C) must:
3434 (1) be witnessed by at least two adults, at least one
3535 of whom is a disinterested witness, who have signed at the request
3636 of the donor or the other person, or be acknowledged before a notary
3737 public; and
3838 (2) state that the record has been signed and
3939 witnessed or acknowledged as provided in Subdivision (1).
4040 SECTION 4. Section 692A.007(b), Health and Safety Code, is
4141 amended to read as follows:
4242 (b) A record signed pursuant to Subsection (a)(1)(B) must:
4343 (1) be witnessed by at least two adults, at least one
4444 of whom is a disinterested witness, who have signed at the request
4545 of the individual, or be acknowledged before a notary public; and
4646 (2) state that the record has been signed and
4747 witnessed or acknowledged as provided in Subdivision (1).
4848 SECTION 5. Chapter 692, Health and Safety Code, is
4949 repealed.
5050 SECTION 6. Sections 692A.005, 692A.006, and 692A.007,
5151 Health and Safety Code, as amended by this Act, apply only to the
5252 validity of a record executed on or after the effective date of this
5353 Act. The validity of a record executed before the effective date of
5454 this Act is governed by the law in effect on the date the record was
5555 executed, and that law continues in effect for that purpose.
5656 SECTION 7. (a) Except as otherwise provided in this
5757 section, the changes in law made by this Act apply to:
5858 (1) a record described by Section 692A.005, 692A.006,
5959 or 692A.007, Health and Safety Code, as amended by this Act, created
6060 before, on, or after the effective date of this Act; and
6161 (2) a judicial proceeding concerning a record
6262 described by Subdivision (1) of this subsection that:
6363 (A) commences on or after the effective date of
6464 this Act; or
6565 (B) is pending on the effective date of this Act.
6666 (b) If the court finds that application of a provision of
6767 this Act would substantially interfere with the effective conduct
6868 of a judicial proceeding concerning a record described by
6969 Subsection (a)(1) of this section that is pending on the effective
7070 date of this Act or prejudice the rights of a party to the
7171 proceeding, the provision of this Act does not apply, and the law in
7272 effect immediately before the effective date of this Act applies in
7373 those circumstances.
7474 SECTION 8. This Act takes effect September 1, 2021.
