55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the punishment for possession of small amounts of
88 certain controlled substances listed in Penalty Group 2.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 481.116, Health and Safety Code, is
1111 amended by adding Subsection (a-1) to read as follows:
1212 (a-1) Notwithstanding any other provision of this section,
1313 an offense under Subsection (a) is a Class B misdemeanor if the
1414 conduct constituting the offense consisted of possessing one
1515 e-cigarette, as defined by Section 161.081, containing
1616 tetrahydrocannabinol or a tetrahydrocannabinol derivative or
1717 analogue.
1818 SECTION 2. The change in law made by this Act applies only
1919 to an offense committed on or after the effective date of this Act.
2020 An offense committed before the effective date of this Act is
2121 governed by the law in effect on the date the offense was committed,
2222 and the former law is continued in effect for that purpose. For
2323 purposes of this section, an offense was committed before the
2424 effective date of this Act if any element of the offense was
2525 committed before that date.
2626 SECTION 3. This Act takes effect September 1, 2021.
