8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Chapter 93, Property Code, is amended by adding | |
10 | 10 | Section 93.0125 to read as follows: | |
11 | 11 | Sec. 93.0125. INDEMNIFICATION CLAUSE PROHIBITED. (a) A | |
12 | 12 | commercial lease may not contain an indemnification clause that | |
13 | 13 | requires the tenant to indemnify or hold harmless the landlord from | |
14 | 14 | claims or liabilities resulting from the negligent acts or | |
15 | 15 | omissions of the tenant. | |
16 | 16 | (b) An indemnification clause in a commercial lease is void. | |
17 | 17 | SECTION 2. The change in law made by this Act applies only | |
18 | 18 | to a commercial lease entered into or renewed on or after the | |
19 | 19 | effective date of this Act. A commercial lease entered into or | |
20 | 20 | renewed before that date is governed by the law in effect | |
21 | 21 | immediately before the effective date of this Act, and that law is | |
22 | 22 | continued in effect for that purpose. | |
23 | 23 | SECTION 3. This Act takes effect September 1, 2021. |
