77 relating to indemnification clauses in commercial leases.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 93, Property Code, is amended by adding
1010 Section 93.0125 to read as follows:
1111 Sec. 93.0125. INDEMNIFICATION CLAUSE PROHIBITED. (a) A
1212 commercial lease may not contain an indemnification clause that
1313 requires the tenant to indemnify or hold harmless the landlord from
1414 claims or liabilities resulting from the negligent acts or
1515 omissions of the tenant.
1616 (b) An indemnification clause in a commercial lease is void.
1717 SECTION 2. The change in law made by this Act applies only
1818 to a commercial lease entered into or renewed on or after the
1919 effective date of this Act. A commercial lease entered into or
2020 renewed before that date is governed by the law in effect
2121 immediately before the effective date of this Act, and that law is
2222 continued in effect for that purpose.
2323 SECTION 3. This Act takes effect September 1, 2021.
