55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to voluntary and informed consent to an abortion.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 171.012(a), Health and Safety Code, is
1010 amended to read as follows:
1111 (a) Consent to an abortion is voluntary and informed only
1212 if:
1313 (1) the physician who is to perform the abortion
1414 informs the pregnant woman on whom the abortion is to be performed
1515 of:
1616 (A) the physician's name;
1717 (B) the particular medical risks associated with
1818 the particular abortion procedure to be employed, including, when
1919 medically accurate:
2020 (i) the risks of infection and hemorrhage;
2121 (ii) the potential danger to a subsequent
2222 pregnancy and of infertility; and
2323 (iii) the possibility of increased risk of
2424 breast cancer following an induced abortion and the natural
2525 protective effect of a completed pregnancy in avoiding breast
2626 cancer;
2727 (C) the probable gestational age of the unborn
2828 child at the time the abortion is to be performed; and
2929 (D) the medical risks associated with carrying
3030 the child to term;
3131 (2) the physician who is to perform the abortion or the
3232 physician's agent informs the pregnant woman that:
3333 (A) medical assistance benefits may be available
3434 for prenatal care, childbirth, and neonatal care;
3535 (B) the father is liable for assistance in the
3636 support of the child without regard to whether the father has
3737 offered to pay for the abortion; [and]
3838 (C) public and private agencies provide
3939 pregnancy prevention counseling and medical referrals for
4040 obtaining pregnancy prevention medications or devices, including
4141 emergency contraception for victims of rape or incest; and
4242 (D) a person commits a criminal offense if the
4343 person causes or threatens bodily injury to a pregnant woman to
4444 force the woman to have an abortion;
4545 (3) the physician who is to perform the abortion or the
4646 physician's agent:
4747 (A) provides the pregnant woman with the printed
4848 materials described by Section 171.014; and
4949 (B) informs the pregnant woman that those
5050 materials:
5151 (i) have been provided by the Department of
5252 State Health Services;
5353 (ii) are accessible on an Internet website
5454 sponsored by the department;
5555 (iii) describe the unborn child and list
5656 agencies that offer alternatives to abortion; and
5757 (iv) include a list of agencies that offer
5858 sonogram services at no cost to the pregnant woman;
5959 (4) before any sedative or anesthesia is administered
6060 to the pregnant woman and at least 24 hours before the abortion or
6161 at least two hours before the abortion if the pregnant woman waives
6262 this requirement by certifying that she currently lives 100 miles
6363 or more from the nearest abortion provider that is a facility
6464 licensed under Chapter 245 or a facility that performs more than 50
6565 abortions in any 12-month period:
6666 (A) the physician who is to perform the abortion
6767 or an agent of the physician who is also a sonographer certified by
6868 a national registry of medical sonographers performs a sonogram on
6969 the pregnant woman on whom the abortion is to be performed;
7070 (B) the physician who is to perform the abortion
7171 displays the sonogram images in a quality consistent with current
7272 medical practice in a manner that the pregnant woman may view them;
7373 (C) the physician who is to perform the abortion
7474 provides, in a manner understandable to a layperson, a verbal
7575 explanation of the results of the sonogram images, including a
7676 medical description of the dimensions of the embryo or fetus, the
7777 presence of cardiac activity, and the presence of external members
7878 and internal organs; and
7979 (D) the physician who is to perform the abortion
8080 or an agent of the physician who is also a sonographer certified by
8181 a national registry of medical sonographers makes audible the heart
8282 auscultation for the pregnant woman to hear, if present, in a
8383 quality consistent with current medical practice and provides, in a
8484 manner understandable to a layperson, a simultaneous verbal
8585 explanation of the heart auscultation;
8686 (5) before receiving a sonogram under Subdivision
8787 (4)(A) and before the abortion is performed and before any sedative
8888 or anesthesia is administered, the pregnant woman completes and
8989 certifies with her signature an election form that states as
9090 follows:
9191 "ABORTION AND SONOGRAM ELECTION
9292 (1) THE INFORMATION AND PRINTED MATERIALS DESCRIBED BY
9393 SECTIONS 171.012(a)(1)-(3), TEXAS HEALTH AND SAFETY CODE, HAVE BEEN
9494 PROVIDED AND EXPLAINED TO ME.
9595 (2) I UNDERSTAND THE NATURE AND CONSEQUENCES OF AN
9696 ABORTION.
9797 (3) TEXAS LAW REQUIRES THAT I RECEIVE A SONOGRAM PRIOR
9898 TO RECEIVING AN ABORTION.
9999 (4) I UNDERSTAND THAT I HAVE THE OPTION TO VIEW THE
100100 SONOGRAM IMAGES.
101101 (5) I UNDERSTAND THAT I HAVE THE OPTION TO HEAR THE
102102 HEARTBEAT.
103103 (6) I UNDERSTAND THAT I AM REQUIRED BY LAW TO HEAR AN
104104 EXPLANATION OF THE SONOGRAM IMAGES UNLESS I CERTIFY IN WRITING TO
105105 ONE OF THE FOLLOWING:
106106 ___ I AM PREGNANT AS A RESULT OF A SEXUAL ASSAULT,
107107 INCEST, OR OTHER VIOLATION OF THE TEXAS PENAL CODE THAT HAS BEEN
108108 REPORTED TO LAW ENFORCEMENT AUTHORITIES OR THAT HAS NOT BEEN
109109 REPORTED BECAUSE I REASONABLY BELIEVE THAT DOING SO WOULD PUT ME AT
110110 RISK OF RETALIATION RESULTING IN SERIOUS BODILY INJURY.
111111 ___ I AM A MINOR AND OBTAINING AN ABORTION IN ACCORDANCE
112112 WITH JUDICIAL BYPASS PROCEDURES UNDER CHAPTER 33, TEXAS FAMILY
113113 CODE.
114114 ___ MY FETUS HAS AN IRREVERSIBLE MEDICAL CONDITION OR
115115 ABNORMALITY, AS IDENTIFIED BY RELIABLE DIAGNOSTIC PROCEDURES AND
116116 DOCUMENTED IN MY MEDICAL FILE.
117117 (7) I UNDERSTAND THAT A PERSON VIOLATES THE TEXAS
118118 PENAL CODE BY CAUSING OR THREATENING BODILY INJURY TO A PREGNANT
119119 WOMAN TO FORCE THE WOMAN TO HAVE AN ABORTION AND THAT I HAVE A RIGHT
120120 TO CONTACT ANY LOCAL OR STATE LAW ENFORCEMENT AGENCY TO RECEIVE
121121 PROTECTION FROM ANY ACTUAL OR THREATENED PHYSICAL ABUSE OR
122122 VIOLENCE, WHICH IS CONDUCT CLASSIFIED AS AN ASSAULT UNDER THE TEXAS
123123 PENAL CODE.
124124 (8) [(7)] I AM MAKING THIS ELECTION OF MY OWN FREE WILL
125125 AND WITHOUT COERCION.
126126 (9) [(8)] FOR A WOMAN WHO LIVES 100 MILES OR MORE FROM
127127 THE NEAREST ABORTION PROVIDER THAT IS A FACILITY LICENSED UNDER
128128 CHAPTER 245 OR A FACILITY THAT PERFORMS MORE THAN 50 ABORTIONS IN
129129 ANY 12-MONTH PERIOD ONLY:
130130 I CERTIFY THAT, BECAUSE I CURRENTLY LIVE 100 MILES OR
131131 MORE FROM THE NEAREST ABORTION PROVIDER THAT IS A FACILITY LICENSED
132132 UNDER CHAPTER 245 OR A FACILITY THAT PERFORMS MORE THAN 50 ABORTIONS
133133 IN ANY 12-MONTH PERIOD, I WAIVE THE REQUIREMENT TO WAIT 24 HOURS
134134 AFTER THE SONOGRAM IS PERFORMED BEFORE RECEIVING THE ABORTION

139139 (6) before the abortion is performed, the physician
140140 who is to perform the abortion receives a copy of the signed,
141141 written certification required by Subdivision (5); and
142142 (7) the pregnant woman is provided the name of each
143143 person who provides or explains the information required under this
144144 subsection.
145145 SECTION 2. Sections 171.014(a) and (f), Health and Safety
146146 Code, are amended to read as follows:
147147 (a) The department shall publish informational materials
148148 that include:
149149 (1) the information required to be provided under
150150 Sections 171.012(a)(1)(B) and (D) and (a)(2)(A), (B), [and] (C),
151151 and (D); and
152152 (2) the materials required by Sections 171.015 and
153153 171.016.
154154 (f) In addition to any other organization or entity, the
155155 department shall use the American College of Obstetricians and
156156 Gynecologists as the resource in developing information required to
157157 be provided under Sections 171.012(a)(1)(B) and (D), Sections
158158 171.012(a)(2)(A), (B), [and] (C), and (D), and Section 171.016, and
159159 in maintaining the department's Internet website.
160160 SECTION 3. (a) By not later than December 1, 2021, the
161161 Health and Human Services Commission shall:
162162 (1) revise the informational materials the commission
163163 is required to publish under Section 171.014, Health and Safety
164164 Code, as amended by this Act; and
165165 (2) make the materials available for distribution.
166166 (b) The changes in law made by this Act apply only to the
167167 information a physician is required to provide under Section
168168 171.012, Health and Safety Code, as amended by this Act, on or after
169169 January 1, 2022.
170170 SECTION 4. This Act takes effect September 1, 2021.
