| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 12.106, Education Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (a-2) and adding Subsection (a-5) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (a-2) Subject to Subsection (a-5) and in [In] addition to |
|---|
| 14 | 14 | | the funding provided by Subsection (a), a charter holder is |
|---|
| 15 | 15 | | entitled to receive for the open-enrollment charter school an |
|---|
| 16 | 16 | | allotment per student in average daily attendance in an amount |
|---|
| 17 | 17 | | equal to the lesser of: |
|---|
| 18 | 18 | | (1) the difference between: |
|---|
| 19 | 19 | | (A) [(1)] the product of: |
|---|
| 20 | 20 | | (i) [(A)] the quotient of: |
|---|
| 21 | 21 | | (a) [(i)] the total amount of funding |
|---|
| 22 | 22 | | provided to eligible school districts under Section 48.101(b) or |
|---|
| 23 | 23 | | (c); and |
|---|
| 24 | 24 | | (b) [(ii)] the total number of |
|---|
| 25 | 25 | | students in average daily attendance in school districts that |
|---|
| 26 | 26 | | receive an allotment under Section 48.101(b) or (c); and |
|---|
| 27 | 27 | | (ii) [(B)] the sum of one and the quotient |
|---|
| 28 | 28 | | of: |
|---|
| 29 | 29 | | (a) [(i)] the total number of |
|---|
| 30 | 30 | | students in average daily attendance in school districts that |
|---|
| 31 | 31 | | receive an allotment under Section 48.101(b) or (c); and |
|---|
| 32 | 32 | | (b) [(ii)] the total number of |
|---|
| 33 | 33 | | students in average daily attendance in school districts statewide; |
|---|
| 34 | 34 | | and |
|---|
| 35 | 35 | | (B) [(2)] $125; or |
|---|
| 36 | 36 | | (2) the average allotment per student in average daily |
|---|
| 37 | 37 | | attendance under Section 48.101 for the school districts in the |
|---|
| 38 | 38 | | county in which the student resides. |
|---|
| 39 | 39 | | (a-5) Notwithstanding Subsection (a-2), the amount of the |
|---|
| 40 | 40 | | allotment per student in average daily attendance to which a |
|---|
| 41 | 41 | | charter holder is entitled to receive for an open-enrollment |
|---|
| 42 | 42 | | charter school under that subsection is an amount equal to: |
|---|
| 43 | 43 | | (1) half of the amount computed under that subsection |
|---|
| 44 | 44 | | if the school has at least 1,601 but not more than 5,000 students in |
|---|
| 45 | 45 | | average daily attendance; and |
|---|
| 46 | 46 | | (2) zero if the school has more than 5,000 students in |
|---|
| 47 | 47 | | average daily attendance. |
|---|
| 48 | 48 | | SECTION 2. This Act takes effect September 1, 2021. |
