58 AN ACT
69 relating to the punishment for the criminal offense of use of laser
710 pointers; increasing a criminal penalty.
811 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
912 SECTION 1. Section 42.13, Penal Code, is amended by
10- amending Subsection (c) and adding Subsections (d) and (e) to read
11- as follows:

1215 (c) An offense under this section is a Class C misdemeanor,
1316 except that the offense is a felony of the third degree if the
1417 conduct causes serious bodily injury to the officer.
15- (d) It is a defense to prosecution under this section that
16- at the time of the offense the actor was discharging the actor's
17- duties as a lighting technician at a venue which produces or hosts
18- events involving laser pointers, including a concert or similar
19- event.
20- (e) If conduct that constitutes an offense under this

2321 SECTION 2. The change in law made by this Act applies only
2422 to an offense committed on or after the effective date of this Act.
2523 An offense committed before the effective date of this Act is
2624 governed by the law in effect on the date the offense was committed,
2725 and the former law is continued in effect for that purpose. For
2826 purposes of this section, an offense was committed before the
2927 effective date of this Act if any element of the offense was
3028 committed before that date.
3129 SECTION 3. This Act takes effect September 1, 2021.
