| 5 | 11 | | relating to the enforcement of commercial motor vehicle safety |
|---|
| 6 | 12 | | standards in certain counties. |
|---|
| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 8 | 14 | | SECTION 1. Section 644.101(c), Transportation Code, as |
|---|
| 9 | 15 | | amended by Chapters 169 (H.B. 917) and 478 (H.B. 511), Acts of the |
|---|
| 10 | 16 | | 86th Legislature, Regular Session, 2019, is reenacted and amended |
|---|
| 11 | 17 | | to read as follows: |
|---|
| 12 | 18 | | (c) A sheriff or a deputy sheriff of any of the following |
|---|
| 13 | 19 | | counties is eligible to apply for certification under this section: |
|---|
| 14 | 20 | | (1) a county bordering the United Mexican States; |
|---|
| 15 | 21 | | (2) a county with a population of less than 1,000, part |
|---|
| 16 | 22 | | of which is located within 75 miles of an international border; [or] |
|---|
| 17 | 23 | | (3) [(2)] a county with a population of 700,000 or |
|---|
| 18 | 24 | | more; [or] |
|---|
| 19 | 25 | | (4) [(3)] a county with a population of 400,000 or |
|---|
| 20 | 26 | | more that borders the county in which the State Capitol is located; |
|---|
| 21 | 27 | | or |
|---|
| 22 | 28 | | (5) a county with a population of less than 250,000 |
|---|
| 23 | 29 | | that: |
|---|
| 24 | 30 | | (A) is adjacent to two counties that each have a |
|---|
| 25 | 31 | | population of more than 1.2 million; and |
|---|
| 26 | 32 | | (B) contains two highways that are part of the |
|---|
| 27 | 33 | | national system of interstate and defense highways. |
|---|
| 28 | 34 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 38 | | Act takes effect September 1, 2021. |
