66 AN ACT
77 relating to coverage for conversion therapy by a health benefit
88 plan offered by a public employer.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle E, Title 8, Insurance Code, is amended
1111 by adding Chapter 1381 to read as follows:
1212 CHAPTER 1381. PROHIBITION ON COVERAGE OF CONVERSION THERAPY
1313 Sec. 1381.001. DEFINITIONS. In this chapter:
1414 (1) "Conversion therapy" means a practice or treatment
1515 provided to a person by a health care provider or nonprofit
1616 organization that seeks to:
1717 (A) change the person's sexual orientation,
1818 including by attempting to change the person's behavior or gender
1919 identity or expression; or
2020 (B) eliminate or reduce the person's sexual or
2121 romantic attractions or feelings toward individuals of the same
2222 sex.
2323 (2) "Gender identity or expression" means a person's
2424 having, or being perceived as having, a gender-related identity,
2525 appearance, expression, or behavior, whether or not that identity,
2626 appearance, expression, or behavior is different from that commonly
2727 associated with the person's assigned sex at birth.
2828 (3) "Public employer" has the meaning assigned by
2929 Section 619.001, Government Code.
3030 (4) "Sexual orientation" means the actual or perceived
3131 status of a person with respect to the person's sexuality.
3232 Sec. 1381.002. APPLICABILITY OF CHAPTER. (a) This chapter
3333 applies only to a health benefit plan offered to employees by a
3434 public employer that provides benefits for medical or surgical
3535 expenses incurred as a result of a health condition, accident, or
3636 sickness, including an individual, group, blanket, or franchise
3737 insurance policy or insurance agreement, a group hospital service
3838 contract, or an individual or group evidence of coverage or similar
3939 coverage document that is issued by:
4040 (1) an insurance company;
4141 (2) a group hospital service corporation operating
4242 under Chapter 842;
4343 (3) a health maintenance organization operating under
4444 Chapter 843;
4545 (4) an approved nonprofit health corporation that
4646 holds a certificate of authority under Chapter 844;
4747 (5) a multiple employer welfare arrangement that holds
4848 a certificate of authority under Chapter 846; or
4949 (6) a stipulated premium company operating under
5050 Chapter 884.
5151 (b) Notwithstanding any other law, this chapter applies to:
5252 (1) a small employer health benefit plan subject to
5353 Chapter 1501, including coverage provided through a health group
5454 cooperative under Subchapter B of that chapter, if offered by a
5555 public employer;
5656 (2) a standard health benefit plan issued under
5757 Chapter 1507, if offered by a public employer;
5858 (3) a basic coverage plan under Chapter 1551;
5959 (4) a basic plan under Chapter 1575;
6060 (5) a primary care coverage plan under Chapter 1579;
6161 (6) a plan providing basic coverage under Chapter
6262 1601;
6363 (7) a regional or local health care program operated
6464 under Section 75.104, Health and Safety Code, if offered by a public
6565 employer;
6666 (8) county employee group health benefits provided
6767 under Chapter 157, Local Government Code; and
6868 (9) health and accident coverage provided by a risk
6969 pool created under Chapter 172, Local Government Code.
7070 Sec. 1381.003. PROHIBITED COVERAGE. A health benefit plan
7171 to which this chapter applies may not provide coverage for
7272 conversion therapy.
7373 SECTION 2. The change in law made by this Act applies only
7474 to a health benefit plan that is delivered, issued for delivery, or
7575 renewed on or after January 1, 2022. A health benefit plan that is
7676 delivered, issued for delivery, or renewed before January 1, 2022,
7777 is governed by the law as it existed immediately before the
7878 effective date of this Act, and that law is continued in effect for
7979 that purpose.
8080 SECTION 3. This Act takes effect September 1, 2021.
