8 | 8 | | plan offered by a public employer. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subtitle E, Title 8, Insurance Code, is amended |
---|
11 | 11 | | by adding Chapter 1381 to read as follows: |
---|
12 | 12 | | CHAPTER 1381. PROHIBITION ON COVERAGE OF CONVERSION THERAPY |
---|
13 | 13 | | Sec. 1381.001. DEFINITIONS. In this chapter: |
---|
14 | 14 | | (1) "Conversion therapy" means a practice or treatment |
---|
15 | 15 | | provided to a person by a health care provider or nonprofit |
---|
16 | 16 | | organization that seeks to: |
---|
17 | 17 | | (A) change the person's sexual orientation, |
---|
18 | 18 | | including by attempting to change the person's behavior or gender |
---|
19 | 19 | | identity or expression; or |
---|
20 | 20 | | (B) eliminate or reduce the person's sexual or |
---|
21 | 21 | | romantic attractions or feelings toward individuals of the same |
---|
22 | 22 | | sex. |
---|
23 | 23 | | (2) "Gender identity or expression" means a person's |
---|
24 | 24 | | having, or being perceived as having, a gender-related identity, |
---|
25 | 25 | | appearance, expression, or behavior, whether or not that identity, |
---|
26 | 26 | | appearance, expression, or behavior is different from that commonly |
---|
27 | 27 | | associated with the person's assigned sex at birth. |
---|
28 | 28 | | (3) "Public employer" has the meaning assigned by |
---|
29 | 29 | | Section 619.001, Government Code. |
---|
30 | 30 | | (4) "Sexual orientation" means the actual or perceived |
---|
31 | 31 | | status of a person with respect to the person's sexuality. |
---|
32 | 32 | | Sec. 1381.002. APPLICABILITY OF CHAPTER. (a) This chapter |
---|
33 | 33 | | applies only to a health benefit plan offered to employees by a |
---|
34 | 34 | | public employer that provides benefits for medical or surgical |
---|
35 | 35 | | expenses incurred as a result of a health condition, accident, or |
---|
36 | 36 | | sickness, including an individual, group, blanket, or franchise |
---|
37 | 37 | | insurance policy or insurance agreement, a group hospital service |
---|
38 | 38 | | contract, or an individual or group evidence of coverage or similar |
---|
39 | 39 | | coverage document that is issued by: |
---|
40 | 40 | | (1) an insurance company; |
---|
41 | 41 | | (2) a group hospital service corporation operating |
---|
42 | 42 | | under Chapter 842; |
---|
43 | 43 | | (3) a health maintenance organization operating under |
---|
44 | 44 | | Chapter 843; |
---|
45 | 45 | | (4) an approved nonprofit health corporation that |
---|
46 | 46 | | holds a certificate of authority under Chapter 844; |
---|
47 | 47 | | (5) a multiple employer welfare arrangement that holds |
---|
48 | 48 | | a certificate of authority under Chapter 846; or |
---|
49 | 49 | | (6) a stipulated premium company operating under |
---|
50 | 50 | | Chapter 884. |
---|
51 | 51 | | (b) Notwithstanding any other law, this chapter applies to: |
---|
52 | 52 | | (1) a small employer health benefit plan subject to |
---|
53 | 53 | | Chapter 1501, including coverage provided through a health group |
---|
54 | 54 | | cooperative under Subchapter B of that chapter, if offered by a |
---|
55 | 55 | | public employer; |
---|
56 | 56 | | (2) a standard health benefit plan issued under |
---|
57 | 57 | | Chapter 1507, if offered by a public employer; |
---|
58 | 58 | | (3) a basic coverage plan under Chapter 1551; |
---|
59 | 59 | | (4) a basic plan under Chapter 1575; |
---|
60 | 60 | | (5) a primary care coverage plan under Chapter 1579; |
---|
61 | 61 | | (6) a plan providing basic coverage under Chapter |
---|
62 | 62 | | 1601; |
---|
63 | 63 | | (7) a regional or local health care program operated |
---|
64 | 64 | | under Section 75.104, Health and Safety Code, if offered by a public |
---|
65 | 65 | | employer; |
---|
66 | 66 | | (8) county employee group health benefits provided |
---|
67 | 67 | | under Chapter 157, Local Government Code; and |
---|
68 | 68 | | (9) health and accident coverage provided by a risk |
---|
69 | 69 | | pool created under Chapter 172, Local Government Code. |
---|
70 | 70 | | Sec. 1381.003. PROHIBITED COVERAGE. A health benefit plan |
---|
71 | 71 | | to which this chapter applies may not provide coverage for |
---|
72 | 72 | | conversion therapy. |
---|
73 | 73 | | SECTION 2. The change in law made by this Act applies only |
---|
74 | 74 | | to a health benefit plan that is delivered, issued for delivery, or |
---|
75 | 75 | | renewed on or after January 1, 2022. A health benefit plan that is |
---|
76 | 76 | | delivered, issued for delivery, or renewed before January 1, 2022, |
---|
77 | 77 | | is governed by the law as it existed immediately before the |
---|
78 | 78 | | effective date of this Act, and that law is continued in effect for |
---|
79 | 79 | | that purpose. |
---|
80 | 80 | | SECTION 3. This Act takes effect September 1, 2021. |
