4	12		AN ACT
5	13		relating to the conduct and promotion of charitable raffles.
6	14		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	15		SECTION 1. Section 2002.003(e), Occupations Code, is
8	16		amended to read as follows:
9	17		(e) A nonprofit wildlife conservation association and its
10	18		local chapters, affiliates, wildlife cooperatives, or units are
11	19		qualified nonprofit organizations under this chapter if the parent
12	20		association meets the eligibility criteria under this section other
13	21		than the requirement prescribed by Subsection (a)(3), (b)(3),
14	22		(b-1)(3), or (c)(3), as applicable. An association or a local
15	23		chapter, affiliate, wildlife cooperative, or unit that is eligible
16	24		under this subsection may not use any proceeds from a raffle
17	25		conducted under this chapter to attempt to influence legislation or
18	26		participate or intervene in a political campaign on behalf of a
19	27		candidate for public office in any manner, including by publishing
20	28		or distributing a statement or making a campaign contribution. [A
21	29		nonprofit wildlife conservation association may conduct two
22	30		raffles each year and each local chapter, affiliate, wildlife
23	31		cooperative, or unit may conduct two raffles each year under this
24	32		chapter.] For purposes of this section, a nonprofit wildlife
25	33		conservation association includes an association that supports
26	34		wildlife, fish, or fowl.
27	35		SECTION 2. Section 2002.052(b), Occupations Code, is
28	36		amended to read as follows:
29	37		(b) A raffle is not authorized by this chapter if the
30	38		organization [sells or offers to sell tickets for or] awards prizes
31	39		in the raffle in a calendar year in which the organization has
32	40		previously [sold or offered to sell tickets for or] awarded prizes
33	41		in four [two or more] other raffles. For purposes of this
34	42		subsection, a raffle conducted in a preceding calendar year for
35	43		which a prize or prizes are awarded on a later date set in
36	44		accordance with Subsection (e) that occurs in a subsequent calendar
37	45		year is not included in the number of raffles for which prizes are
38	46		awarded by the organization in that subsequent calendar year.
39	47		SECTION 3. Sections 2002.056(b) and (c), Occupations Code,
40	48		are amended to read as follows:
41	49		(b) Except as provided by Subsections (b-1) and (c), the
42	50		value of a prize offered or awarded at a raffle that is purchased by
43	51		the organization or for which the organization provides any
44	52		consideration may not exceed $75,000 [$50,000].
45	53		(c) A raffle prize may consist of one or more tickets in the
46	54		state lottery authorized by Chapter 466, Government Code, with a
47	55		face value of $75,000 [$50,000] or less, without regard to whether a
48	56		prize in the lottery game to which the ticket or tickets relate
49	57		exceeds $75,000 [$50,000].
50	58		SECTION 4. Section 2002.052(c), Occupations Code, is
51	59		repealed.
52	60		SECTION 5. This Act takes effect immediately if it receives
53	61		a vote of two-thirds of all the members elected to each house, as
54	62		provided by Section 39, Article III, Texas Constitution. If this
55	63		Act does not receive the vote necessary for immediate effect, this
56	64		Act takes effect September 1, 2021.
