| 10 | 10 | SECTION 1. Section 39.151, Utilities Code, is amended by | |
| 11 | 11 | adding Subsections (g-2) and (g-3) to read as follows: | |
| 12 | 12 | (g-2) To qualify to serve as a member of the governing body | |
| 13 | 13 | under Subsection (g)(4), (5), (6), or (7), a person must be a | |
| 14 | 14 | resident of this state. | |
| 15 | 15 | (g-3) To maintain certification as an independent | |
| 16 | 16 | organization under this section, an organization's chief executive | |
| 17 | 17 | officer must be a resident of this state. | |
| 18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
| 19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
| 20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
| 21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
| 22 | 22 | Act takes effect September 1, 2021. |
