| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1003.051, Special District Local Laws |
|---|
| 11 | 11 | | Code, is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 1003.051. BOARD. The district is governed by a board |
|---|
| 13 | 13 | | of five [seven] directors. |
|---|
| 14 | 14 | | SECTION 2. Section 1003.052(a), Special District Local Laws |
|---|
| 15 | 15 | | Code, is amended to read as follows: |
|---|
| 16 | 16 | | (a) Unless a four-year term is established under Section |
|---|
| 17 | 17 | | 285.081, Health and Safety Code: |
|---|
| 18 | 18 | | (1) directors serve staggered terms of two years; |
|---|
| 19 | 19 | | (2) two [three] directors shall be elected in |
|---|
| 20 | 20 | | odd-numbered years and three [four] directors shall be elected in |
|---|
| 21 | 21 | | even-numbered years; and |
|---|
| 22 | 22 | | (3) a directors election shall be held on the first |
|---|
| 23 | 23 | | Saturday in May of each year to elect the appropriate number of |
|---|
| 24 | 24 | | directors. |
|---|
| 25 | 25 | | SECTION 3. (a) At the election for directors of the Booker |
|---|
| 26 | 26 | | Hospital District to be held on May 7, 2022, five directors shall be |
|---|
| 27 | 27 | | elected. The three directors who receive the three highest number |
|---|
| 28 | 28 | | of total votes cast at the election shall serve two-year terms and |
|---|
| 29 | 29 | | the two directors who receive the fourth and fifth highest number of |
|---|
| 30 | 30 | | total votes cast at the election shall serve one-year terms. |

| 31 | 31 | | (b) Notwithstanding Section 1003.051, Special District |
|---|
| 32 | 32 | | Local Laws Code, as amended by this Act, the seven directors serving |
|---|
| 33 | 33 | | on the board of directors immediately before the effective date of |
|---|
| 34 | 34 | | this Act continue to serve as the district's governing body until a |
|---|
| 35 | 35 | | majority of the directors elected on May 7, 2022, take office, and |
|---|
| 36 | 36 | | the former law is continued in effect for that purpose. The terms of |
|---|
| 37 | 37 | | the directors serving on the board of directors immediately before |
|---|
| 38 | 38 | | the effective date of this Act expire on the date a majority of the |
|---|
| 39 | 39 | | directors elected on May 7, 2022, take office. |
|---|
| 40 | 40 | | (c) Service on the board of directors of the district before |
|---|
| 41 | 41 | | May 7, 2022, does not make a person ineligible for election as a |
|---|
| 42 | 42 | | director of the district at the election held on May 7, 2022, or at a |
|---|
| 43 | 43 | | subsequent election of district directors. |
|---|
| 44 | 44 | | SECTION 4. This Act takes effect September 1, 2021. |
