55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution and punishment of the offense of
88 prostitution and to a fine imposed on conviction of certain
99 trafficking of persons and prostitution offenses.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 102, Code of Criminal
1212 Procedure, is amended by adding Article 102.0187 to read as
1313 follows:
1414 Art. 102.0187. FINES: COMMERCIAL SEXUAL EXPLOITATION
1515 VICTIM FUND. (a) The commercial sexual exploitation victim fund is
1616 a dedicated account in the general revenue fund.
1717 (b) A person convicted of an offense under Section 20A.02,
1818 20A.03, or 43.02(b), Penal Code, shall pay $500 as a fine on
1919 conviction of the offense.
2020 (c) For purposes of this article, a person is considered to
2121 have been convicted if:
2222 (1) a sentence is imposed on the person; or
2323 (2) the person receives community supervision,
2424 including deferred adjudication community supervision.
2525 (d) Fines imposed under this article are collected in the
2626 same manner as other fines or costs. An officer collecting the
2727 fines shall keep separate records of the funds collected as fines
2828 under this article and shall deposit the funds in the county
2929 treasury.
3030 (e) The custodian of a county treasury shall:
3131 (1) keep records of the amount of funds on deposit
3232 collected under this article; and
3333 (2) send to the comptroller before the last day of the
3434 first month following each calendar quarter the funds collected
3535 under this article during the preceding quarter.
3636 (f) If no funds due as fines under this article are
3737 deposited in a county treasury in a calendar quarter, the custodian
3838 of the treasury shall file the report required for the quarter in
3939 the regular manner and must state that no funds were collected.
4040 (g) The comptroller shall deposit the funds received under
4141 this article to the credit of a dedicated account in the general
4242 revenue fund to be known as the commercial sexual exploitation
4343 victim fund. The legislature may appropriate money from the
4444 account only to the criminal justice division of the governor's
4545 office to enable that division to provide funds for services and
4646 programs directed toward victims of conduct that constitutes an
4747 offense under Section 20A.02 or 43.05, Penal Code, including:
4848 (1) diversion programs for victims who have been
4949 charged with an offense;
5050 (2) housing;
5151 (3) vocational services;
5252 (4) counseling;
5353 (5) substance abuse recovery services;
5454 (6) mental health services; and
5555 (7) prostitution prevention programs.
5656 (h) Funds collected under this article are subject to audit
5757 by the comptroller.
5858 SECTION 2. Section 43.02, Penal Code, is amended by adding
5959 Subsection (b-1) and amending Subsection (c) to read as follows:
6060 (b-1) A person may not be prosecuted for an offense under
6161 Subsection (a) that the person committed when younger than 18 years
6262 of age.
6363 (c) An offense under Subsection (a) is a Class B
6464 misdemeanor, except that the offense is[:
6565 [(1) a Class A misdemeanor if the actor has previously
6666 been convicted one or two times of an offense under Subsection (a);
6767 or
6868 [(2)] a Class A misdemeanor [state jail felony] if the
6969 actor has previously been convicted three or more times of an
7070 offense under Subsection (a).
7171 SECTION 3. (a) Article 102.0187, Code of Criminal
7272 Procedure, as added by this Act, applies only to a fine on
7373 conviction for an offense committed on or after the effective date
7474 of this Act. An offense committed before the effective date of this
7575 Act is governed by the law in effect on the date the offense was
7676 committed, and the former law is continued in effect for that
7777 purpose.
7878 (b) Section 43.02, Penal Code, as amended by this Act,
7979 applies only to an offense committed on or after the effective date
8080 of this Act. An offense committed before the effective date of this
8181 Act is governed by the law in effect on the date the offense was
8282 committed, and the former law is continued in effect for that
8383 purpose.
8484 (c) For the purposes of this section, an offense was
8585 committed before the effective date of this Act if any element of
8686 the offense occurred before that date.
8787 SECTION 4. This Act takes effect September 1, 2021.
