55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the limitation on administration and use of certain
88 assessment instruments in public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.023(a), Education Code, as effective
1111 until September 1, 2021, is amended to read as follows:
1212 (a) The agency shall adopt or develop appropriate
1313 criterion-referenced assessment instruments designed to assess
1414 essential knowledge and skills in reading, [writing,] mathematics,
1515 [social studies,] and science. Except as provided by Subsection
1616 (a-2), all students, other than students assessed under Subsection
1717 (b) or (l) or exempted under Section 39.027, shall be assessed in:
1818 (1) mathematics, annually in grades three through
1919 eight;
2020 (2) reading, annually in grades three through eight;
2121 (3) [writing, including spelling and grammar, in
2222 grades four and seven;
2323 [(4) social studies, in grade eight;
2424 [(5)] science, in grades five and eight; and
2525 (4) [(6)] any other subject and grade required by
2626 federal law.
2727 SECTION 2. Section 39.023(a), Education Code, as effective
2828 September 1, 2021, is amended to read as follows:
2929 (a) The agency shall adopt or develop appropriate
3030 criterion-referenced assessment instruments designed to assess
3131 essential knowledge and skills in reading, mathematics, [social
3232 studies,] and science. Except as provided by Subsection (a-2), all
3333 students, other than students assessed under Subsection (b) or (l)
3434 or exempted under Section 39.027, shall be assessed in:
3535 (1) mathematics, annually in grades three through
3636 eight;
3737 (2) reading, annually in grades three through eight;
3838 (3) [social studies, in grade eight;
3939 [(4)] science, in grades five and eight; and
4040 (4) [(5)] any other subject and grade required by
4141 federal law.
4242 SECTION 3. Section 39.023(c), Education Code, is amended to
4343 read as follows:
4444 (c) The agency shall also adopt end-of-course assessment
4545 instruments for secondary-level courses in Algebra I, biology, and
4646 [English I,] English II[, and United States history]. The Algebra I
4747 end-of-course assessment instrument must be administered with the
4848 aid of technology, but may include one or more parts that prohibit
4949 the use of technology. The [English I and] English II end-of-course
5050 assessment instrument [instruments] must [each] assess essential
5151 knowledge and skills in both reading and writing and must provide a
5252 single score. A school district shall comply with State Board of
5353 Education rules regarding administration of the assessment
5454 instruments listed in this subsection. If a student is in a special
5555 education program under Subchapter A, Chapter 29, the student's
5656 admission, review, and dismissal committee shall determine whether
5757 any allowable modification is necessary in administering to the
5858 student an assessment instrument required under this subsection.
5959 The State Board of Education shall administer the assessment
6060 instruments. An end-of-course assessment instrument may be
6161 administered in multiple parts over more than one day. The State
6262 Board of Education shall adopt a schedule for the administration of
6363 end-of-course assessment instruments that complies with the
6464 requirements of Subsection (c-3).
6565 SECTION 4. Section 39.025(a-1), Education Code, is amended
6666 to read as follows:
6767 (a-1) A student enrolled in a college preparatory
6868 mathematics or English language arts course under Section 28.014
6969 who satisfies the Texas Success Initiative (TSI) college readiness
7070 benchmarks prescribed by the Texas Higher Education Coordinating
7171 Board under Section 51.334 on an assessment instrument designated
7272 by the coordinating board under that section administered at the
7373 end of the college preparatory mathematics or English language arts
7474 course satisfies the requirements concerning and is exempt from the
7575 administration of the Algebra I or the [English I and] English II
7676 end-of-course assessment instrument [instruments], as applicable,
7777 as prescribed by Section 39.023(c), even if the student did not
7878 perform satisfactorily on a previous administration of the
7979 applicable end-of-course assessment instrument. A student who
8080 fails to perform satisfactorily on the assessment instrument
8181 designated by the coordinating board under Section 51.334
8282 administered as provided by this subsection may retake that
8383 assessment instrument for purposes of this subsection or may take
8484 the appropriate end-of-course assessment instrument.
8585 SECTION 5. Section 39.203(c), Education Code, is amended to
8686 read as follows:
8787 (c) In addition to the distinction designations described
8888 by Subsections (a) and (b), a campus that satisfies the criteria
8989 developed under Section 39.204 shall be awarded a distinction
9090 designation by the commissioner for outstanding performance in
9191 academic achievement in English language arts, mathematics, or
9292 science[, or social studies].
9393 SECTION 6. Section 39.0238, Education Code, is repealed.
9494 SECTION 7. This Act applies beginning with the 2021-2022
9595 school year.
9696 SECTION 8. This Act takes effect immediately if it receives
9797 a vote of two-thirds of all the members elected to each house, as
9898 provided by Section 39, Article III, Texas Constitution. If this
9999 Act does not receive the vote necessary for immediate effect, this
100100 Act takes effect September 1, 2021.
