| 7 | 7 | | relating to the board of directors of a public utility agency. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 572.057, Local Government Code, is |
|---|
| 10 | 10 | | amended by amending Subsection (b) and adding Subsections (b-1) and |
|---|
| 11 | 11 | | (c-1) to read as follows: |
|---|
| 12 | 12 | | (b) Except as provided by Subsection (b-1), each [Each] |
|---|
| 13 | 13 | | director must be appointed by place by the governing bodies of the |
|---|
| 14 | 14 | | participating public entities. Each participating public entity is |
|---|
| 15 | 15 | | entitled to appoint at least one director. |
|---|
| 16 | 16 | | (b-1) If a public utility agency has a service area that |
|---|
| 17 | 17 | | includes the unincorporated area of a county that is outside the |
|---|
| 18 | 18 | | boundaries of the agency's participating public entities, the |
|---|
| 19 | 19 | | commissioners court of the county may appoint the same number of |
|---|
| 20 | 20 | | directors as the number appointed by the participating public |
|---|
| 21 | 21 | | entity with the largest population that is less than the population |
|---|
| 22 | 22 | | of the unincorporated area. |
|---|
| 23 | 23 | | (c-1) A director must be a customer of the public utility |
|---|
| 24 | 24 | | agency and reside within the area served by the agency. |
|---|
| 25 | 25 | | SECTION 2. Section 572.057(c-1), Local Government Code, as |
|---|
| 26 | 26 | | added by this Act, applies only to the term of a director that |
|---|
| 27 | 27 | | begins on or after the effective date of this Act. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2021. |
