55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the board of directors of a public utility agency.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 572.057, Local Government Code, is
1010 amended by amending Subsection (b) and adding Subsections (b-1) and
1111 (c-1) to read as follows:
1212 (b) Except as provided by Subsection (b-1), each [Each]
1313 director must be appointed by place by the governing bodies of the
1414 participating public entities. Each participating public entity is
1515 entitled to appoint at least one director.
1616 (b-1) If a public utility agency has a service area that
1717 includes the unincorporated area of a county that is outside the
1818 boundaries of the agency's participating public entities, the
1919 commissioners court of the county may appoint the same number of
2020 directors as the number appointed by the participating public
2121 entity with the largest population that is less than the population
2222 of the unincorporated area.
2323 (c-1) A director must be a customer of the public utility
2424 agency and reside within the area served by the agency.
2525 SECTION 2. Section 572.057(c-1), Local Government Code, as
2626 added by this Act, applies only to the term of a director that
2727 begins on or after the effective date of this Act.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2021.
