55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the issuance of a summons for certain persons charged
88 with a violation of a condition of release on parole or to mandatory
99 supervision.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 508.251(c), Government Code, is amended
1212 to read as follows:
1313 (c) Instead of the issuance of a warrant under this section,
1414 the division:
1515 (1) may issue to the person a summons requiring the
1616 person to appear for a hearing under Section 508.281 if the person:
1717 (A) is not a releasee who is:
1818 (i) on intensive supervision or
1919 superintensive supervision;
2020 (ii) an absconder; or
2121 (iii) determined by the division to be a
2222 threat to public safety; or
2323 (B) is charged only with committing a new offense
2424 that is alleged to have been committed after the first anniversary
2525 of the date the person was released on parole or to mandatory
2626 supervision if:
2727 (i) the new offense is a Class C misdemeanor
2828 under the Penal Code, other than an offense committed against a
2929 child younger than 17 years of age or an offense involving family
3030 violence, as defined by Section 71.004, Family Code;
3131 (ii) the person has maintained steady
3232 employment for at least one year;
3333 (iii) the person has maintained a stable
3434 residence for at least one year; and
3535 (iv) the person has not previously been
3636 charged with an offense after the person was released on parole or
3737 to mandatory supervision; and
3838 (2) shall issue to the person a summons requiring the
3939 person to appear for a hearing under Section 508.281 if the person:
4040 (A) is charged only with committing:
4141 (i) a new offense for which the person has
4242 been released on bond; or
4343 (ii) an administrative violation of release
4444 that is alleged to have been committed after the first anniversary
4545 of the date the person was released on parole or to mandatory
4646 supervision;
4747 (B) is not serving a sentence for, and has not
4848 been previously convicted of, an offense listed in or described by
4949 Article 62.001(5), Code of Criminal Procedure; and
5050 (C) is not a releasee with respect to whom a
5151 summons may not be issued under Subdivision (1).
5252 SECTION 2. This Act takes effect September 1, 2021.
