79 relating to the Texas Armed Services Scholarship Program.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 61.9773(a), Education Code, is amended
1012 to read as follows:
1113 (a) To receive a scholarship under this subchapter, a
1214 student must enter into an agreement with the board as provided by
1315 this section. The agreement must require the student to:
1416 (1) complete:
1517 (A) one year of ROTC training for each year that
1618 the student is enrolled in a degree or certificate program at a
1719 public or private institution of higher education in this state, up
1820 to a maximum requirement of four years of ROTC training; or
1921 (B) [complete] another undergraduate officer
2022 commissioning program such as the United States Marine Corps
2123 Platoon Leaders Class;
2224 (2) graduate not later than six years after the date
2325 the student first enrolls in a public or private institution of
2426 higher education in this state;
2527 (3) after graduation, enter into:
2628 (A) a four-year commitment to be a member of the
2729 Texas Army National Guard, Texas Air National Guard, Texas State
2830 Guard, United States Coast Guard, or United States Merchant Marine;
2931 or
3032 (B) a contract to serve as a commissioned officer
3133 in any branch of the armed services of the United States;
3234 (4) meet the physical examination requirements and all
3335 other prescreening requirements of the Texas Army National Guard,
3436 Texas Air National Guard, Texas State Guard, United States Coast
3537 Guard, or United States Merchant Marine or the branch of the armed
3638 services with which the student enters into a contract; and
3739 (5) agree to repay the scholarship if the student:
3840 (A) fails to maintain satisfactory academic
3941 progress;
4042 (B) withdraws from the scholarship program; or
4143 (C) fails to fulfill a commitment or contract
4244 described by Subdivision (3).
4345 SECTION 2. Subchapter FF, Chapter 61, Education Code, is
4446 amended by adding Section 61.97731 to read as follows:
4547 Sec. 61.97731. NOTICE REGARDING MINIMUM AND REQUIRED ROTC
4648 TRAINING. The board shall post on the board's Internet website and
4749 provide to each student before the student enters into an agreement
4850 with the board under Section 61.9773 information regarding the
4951 number of years of ROTC training that each entity described by
5052 Section 61.9773(a)(3) requires or recommends before entering into a
5153 commitment or contract described by that subdivision.
5254 SECTION 3. Section 61.9773(a), Education Code, as amended
5355 by this Act, applies beginning with a Texas Armed Services
5456 Scholarship awarded for the 2022-2023 academic year. A Texas Armed
5557 Services Scholarship awarded for an academic year before that
5658 academic year is governed by the law in effect when the scholarship
5759 was awarded, and the former law is continued in effect for that
5860 purpose.
5961 SECTION 4. This Act takes effect September 1, 2021.
