7 | 9 | | relating to the Texas Armed Services Scholarship Program. |

8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 11 | | SECTION 1. Section 61.9773(a), Education Code, is amended |
---|
10 | 12 | | to read as follows: |
---|
11 | 13 | | (a) To receive a scholarship under this subchapter, a |
---|
12 | 14 | | student must enter into an agreement with the board as provided by |
---|
13 | 15 | | this section. The agreement must require the student to: |
---|
14 | 16 | | (1) complete: |
---|
15 | 17 | | (A) one year of ROTC training for each year that |
---|
16 | 18 | | the student is enrolled in a degree or certificate program at a |
---|
17 | 19 | | public or private institution of higher education in this state, up |
---|
18 | 20 | | to a maximum requirement of four years of ROTC training; or |
---|
19 | 21 | | (B) [complete] another undergraduate officer |
---|
20 | 22 | | commissioning program such as the United States Marine Corps |
---|
21 | 23 | | Platoon Leaders Class; |
---|
22 | 24 | | (2) graduate not later than six years after the date |
---|
23 | 25 | | the student first enrolls in a public or private institution of |
---|
24 | 26 | | higher education in this state; |
---|
25 | 27 | | (3) after graduation, enter into: |
---|
26 | 28 | | (A) a four-year commitment to be a member of the |
---|
27 | 29 | | Texas Army National Guard, Texas Air National Guard, Texas State |
---|
28 | 30 | | Guard, United States Coast Guard, or United States Merchant Marine; |
---|
29 | 31 | | or |
---|
30 | 32 | | (B) a contract to serve as a commissioned officer |
---|
31 | 33 | | in any branch of the armed services of the United States; |
---|
32 | 34 | | (4) meet the physical examination requirements and all |
---|
33 | 35 | | other prescreening requirements of the Texas Army National Guard, |
---|
34 | 36 | | Texas Air National Guard, Texas State Guard, United States Coast |
---|
35 | 37 | | Guard, or United States Merchant Marine or the branch of the armed |
---|
36 | 38 | | services with which the student enters into a contract; and |
---|
37 | 39 | | (5) agree to repay the scholarship if the student: |
---|
38 | 40 | | (A) fails to maintain satisfactory academic |
---|
39 | 41 | | progress; |
---|
40 | 42 | | (B) withdraws from the scholarship program; or |
---|
41 | 43 | | (C) fails to fulfill a commitment or contract |
---|
42 | 44 | | described by Subdivision (3). |

43 | 45 | | SECTION 2. Subchapter FF, Chapter 61, Education Code, is |
---|
44 | 46 | | amended by adding Section 61.97731 to read as follows: |
---|
45 | 47 | | Sec. 61.97731. NOTICE REGARDING MINIMUM AND REQUIRED ROTC |
---|
46 | 48 | | TRAINING. The board shall post on the board's Internet website and |
---|
47 | 49 | | provide to each student before the student enters into an agreement |
---|
48 | 50 | | with the board under Section 61.9773 information regarding the |
---|
49 | 51 | | number of years of ROTC training that each entity described by |
---|
50 | 52 | | Section 61.9773(a)(3) requires or recommends before entering into a |
---|
51 | 53 | | commitment or contract described by that subdivision. |
---|
52 | 54 | | SECTION 3. Section 61.9773(a), Education Code, as amended |
---|
53 | 55 | | by this Act, applies beginning with a Texas Armed Services |
---|
54 | 56 | | Scholarship awarded for the 2022-2023 academic year. A Texas Armed |
---|
55 | 57 | | Services Scholarship awarded for an academic year before that |
---|
56 | 58 | | academic year is governed by the law in effect when the scholarship |
---|
57 | 59 | | was awarded, and the former law is continued in effect for that |
---|
58 | 60 | | purpose. |
---|
59 | 61 | | SECTION 4. This Act takes effect September 1, 2021. |
