6 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 13 | | SECTION 1. Section 4001.153, Insurance Code, is amended to |
---|
8 | 14 | | read as follows: |
---|
9 | 15 | | Sec. 4001.153. APPLICATION FOR AND ISSUANCE OF TEMPORARY |
---|
10 | 16 | | LICENSE. (a) Except as provided by Subsection (b), the [The] |
---|
11 | 17 | | department shall issue a temporary license immediately on receipt |
---|
12 | 18 | | of a properly completed application executed by the applicant in |
---|
13 | 19 | | the form required by Section 4001.102 and accompanied by: |
---|
14 | 20 | | (1) the nonrefundable filing fee set by the |
---|
15 | 21 | | department; and |
---|
16 | 22 | | (2) a certificate signed by an officer or properly |
---|
17 | 23 | | authorized representative of an agent, insurer, or health |
---|
18 | 24 | | maintenance organization stating that: |
---|
19 | 25 | | (A) the applicant is being considered for |
---|
20 | 26 | | appointment by the agent, insurer, or health maintenance |
---|
21 | 27 | | organization as its full-time agent; |
---|
22 | 28 | | (B) the agent, insurer, or health maintenance |
---|
23 | 29 | | organization desires that the applicant be issued a temporary |
---|
24 | 30 | | license; and |
---|
25 | 31 | | (C) the applicant will complete training as |
---|
26 | 32 | | prescribed by Section 4001.160 under the agent's, insurer's, or |
---|
27 | 33 | | health maintenance organization's supervision. |
---|
28 | 34 | | (b) The department may deny a license application under this |
---|
29 | 35 | | subchapter if the department determines that any of the grounds |
---|
30 | 36 | | exist for license denial or disciplinary action under Section |
---|
31 | 37 | | 4005.101, Insurance Code, or Chapter 53, Occupations Code. |
---|
32 | 38 | | SECTION 2. Section 4001.155, Insurance Code, is amended to |
---|
33 | 39 | | read as follows: |
---|
34 | 40 | | Sec. 4001.155. TERM OF TEMPORARY LICENSE. A temporary |
---|
35 | 41 | | license is valid for 180 [90] days after the date of issuance. |
---|
36 | 42 | | SECTION 3. Section 4001.156(a), Insurance Code, is |
---|
37 | 43 | | repealed. |
---|
38 | 44 | | SECTION 4. The changes in law made by this Act apply only to |
---|
39 | 45 | | an application for a temporary insurance agent's license submitted |
---|
40 | 46 | | on or after the effective date of this Act. An application for a |
---|
41 | 47 | | temporary insurance agent's license submitted before the effective |
---|
42 | 48 | | date of this Act is governed by the law as it existed immediately |
---|
43 | 49 | | before that date, and that law is continued in effect for that |
---|
44 | 50 | | purpose. |
---|
45 | 51 | | SECTION 5. This Act takes effect September 1, 2021. |
