| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 94.002, Agriculture Code, is amended to |
|---|
| 9 | 15 | | read as follows: |
|---|
| 10 | 16 | | Sec. 94.002. EXCEPTIONS. Except to the extent specifically |
|---|
| 11 | 17 | | provided by this chapter, this chapter does not apply to: |
|---|
| 12 | 18 | | (1) citrus fruit other than citrus grandis, osbeck, |
|---|
| 13 | 19 | | commonly known as grapefruit, and citrus sinensis, osbeck, commonly |
|---|
| 14 | 20 | | known as oranges; |
|---|
| 15 | 21 | | (2) a sale of citrus fruit "on the trees"; |
|---|
| 16 | 22 | | (3) grapefruit that is shipped after December 1 of a |
|---|
| 17 | 23 | | year and before August 1 of the following year; |
|---|
| 18 | 24 | | (4) early or midseason oranges that are shipped after |
|---|
| 19 | 25 | | November 1 of a year and before August 1 of the following year; [or] |
|---|
| 20 | 26 | | (5) transportation of citrus fruit from a grove to a |
|---|
| 21 | 27 | | packing house located in this state; or |
|---|
| 22 | 28 | | (6) grapefruit or oranges that are processed for |
|---|
| 23 | 29 | | juice. |
|---|
| 24 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 34 | | Act takes effect September 1, 2021. |
