4	10		AN ACT
5	11		relating to the authority of the Tarrant County Hospital District
6	12		or a nonprofit corporation formed by the district regarding certain
7	13		technology or intellectual property owned by or licensed to the
8	14		district or corporation.
9	15		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	16		SECTION 1. Subchapter C, Chapter 281, Health and Safety
11	17		Code, is amended by adding Section 281.0519 to read as follows:
12	18		Sec. 281.0519. TARRANT COUNTY HOSPITAL DISTRICT; AUTHORITY
13	19		TO SELL OR LICENSE INTELLECTUAL PROPERTY. (a) The Tarrant County
14	20		Hospital District or a nonprofit corporation formed by the district
15	21		may:
16	22		(1) sell or license technology or intellectual
17	23		property that is owned by or licensed to the district or a nonprofit
18	24		corporation formed by the district;
19	25		(2) enter into a contract to provide services related
20	26		to technology or intellectual property sold or licensed under
21	27		Subdivision (1);
22	28		(3) contract, collaborate, or enter into a joint
23	29		venture or other agreement with a public or private entity to engage
24	30		in an activity authorized under Subdivision (1) or (2); or
25	31		(4) take any other action necessary to protect or
26	32		benefit from the exclusivity of technology and intellectual
27	33		property owned by or licensed to the district or a nonprofit
28	34		corporation formed by the district, including applying for,
29	35		acquiring, registering, securing, holding, protecting, and
30	36		renewing under applicable provisions of state, federal, or
31	37		international law:
32	38		(A) a patent;
33	39		(B) a copyright;
34	40		(C) a trademark, service mark, collective mark,
35	41		or certification mark; or
36	42		(D) any other form of protection of intellectual
37	43		property provided by law.
38	44		(b) For purposes of Subsection (a)(3):
39	45		(1) a public or private entity may be a for-profit or a
40	46		nonprofit entity; and
41	47		(2) a nonprofit corporation formed by the district may
42	48		hold an ownership interest in a public or private entity described
43	49		by Subsection (a)(3).
44	50		(c) Information prepared or compiled by or for the Tarrant
45	51		County Hospital District or a nonprofit corporation formed by the
46	52		district relating to the development of technology or intellectual
47	53		property to which this section applies is exempt from public
48	54		disclosure under Chapter 552, Government Code.
49	55		SECTION 2. This Act takes effect immediately if it receives
50	56		a vote of two-thirds of all the members elected to each house, as
51	57		provided by Section 39, Article III, Texas Constitution. If this
52	58		Act does not receive the vote necessary for immediate effect, this
53	59		Act takes effect September 1, 2021.
