97 relating to the secretary of state posting on the secretary of
108 state's Internet website databases containing certain information
119 about elections.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Section 4.003(e), Election Code, is amended to
1412 read as follows:
1513 (e) The authority responsible for giving notice of the
1614 election shall deliver to the secretary of state:
1715 (1) a copy of the notice of a consolidated precinct
1816 required by Subsection (b) not later than the date of the election;
1917 and
2018 (2) information for the secretary of state's database
2119 of election information under Section 31.017 in an electronic
2220 format required by the secretary of state.
2321 SECTION 2. Subchapter A, Chapter 31, Election Code, is
2422 amended by adding Sections 31.017 and 31.018 to read as follows:
2523 Sec. 31.017. INTERNET DATABASE OF ELECTION INFORMATION.
2624 (a) The secretary of state shall post on the secretary of state's
2725 public Internet website a database containing information provided
2826 by each authority responsible for giving notice of an election in
2927 this state. The database must include the following information:
3028 (1) the name of the authority;
3129 (2) each office to be filled at the election;
3230 (3) whether the office is elected at large or by
3331 district; and
3432 (4) the dates of the preceding and next election for
3533 the office.
36- (b) The secretary of state shall adopt rules as necessary to
37- implement this section.
34+ (b) The secretary of state:
35+ (1) may solicit and accept gifts, grants, and
36+ donations from any public or private source for the creation and
37+ maintenance of the database; and
38+ (2) shall adopt rules as necessary to implement this
39+ section.
3840 Sec. 31.018. INTERNET DATABASE FOR INCUMBENTS AND
3941 CANDIDATES. (a) The secretary of state shall post on the secretary
4042 of state's Internet website a database containing information about
4143 each holder of and candidate for any elected office in this state.
4244 (b) The database must include the following information
4345 about a holder of an elected office:
4446 (1) name;
4547 (2) office title, including any district, place, or
4648 position;
4749 (3) if the office is elected at large or by district;
4850 (4) date of the previous and next election for the
4951 office;
5052 (5) public mailing address;
5153 (6) public telephone number, if available; and
5254 (7) public e-mail address, if available.
5355 (c) The database must include the following information
5456 about a candidate for an elected office:
5557 (1) name;
5658 (2) office sought, including any district, place, or
5759 position;
5860 (3) if the office is elected at large or by district;
5961 (4) date of the election;
6062 (5) public mailing address;
6163 (6) public telephone number, if available;
6264 (7) public e-mail address, if available;
6365 (8) name of the incumbent; and
6466 (9) if the candidate has filed as a write-in
6567 candidate.
6668 (d) The authority with whom a declaration of candidacy is
6769 filed, a state chair of a political party, or the presiding officer
6870 of a political party's convention shall provide information about a
6971 candidate or officeholder to the secretary of state.
70- (e) The secretary of state shall adopt rules as necessary to
71- implement this section.
72- SECTION 3. Section 141.032, Election Code, is amended by

74+ SECTION 3. Section 52.003, Election Code, is amended by
75+ adding Subsection (d) to read as follows:
76+ (d) A candidate's name may not be printed on the ballot
77+ until the candidate's name appears on the secretary of state's
78+ Internet website as a candidate for elected office under Section
79+ 31.018.
80+ SECTION 4. Section 141.032, Election Code, is amended by
7381 adding Subsection (h) to read as follows:
7482 (h) The authority with whom the application is filed shall
7583 provide the secretary of state with the candidate's information
7684 required for the secretary of state's Internet website under
7785 Section 31.018.
78- SECTION 4. This Act takes effect September 1, 2021.
86+ SECTION 5. This Act takes effect September 1, 2021.
