8	6		AN ACT
9	7		relating to the secretary of state posting on the secretary of
10	8		state's Internet website databases containing certain information
11	9		about elections.
12	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	11		SECTION 1. Section 4.003(e), Election Code, is amended to
14	12		read as follows:
15	13		(e) The authority responsible for giving notice of the
16	14		election shall deliver to the secretary of state:
17	15		(1) a copy of the notice of a consolidated precinct
18	16		required by Subsection (b) not later than the date of the election;
19	17		and
20	18		(2) information for the secretary of state's database
21	19		of election information under Section 31.017 in an electronic
22	20		format required by the secretary of state.
23	21		SECTION 2. Subchapter A, Chapter 31, Election Code, is
24	22		amended by adding Sections 31.017 and 31.018 to read as follows:
25	23		Sec. 31.017. INTERNET DATABASE OF ELECTION INFORMATION.
26	24		(a) The secretary of state shall post on the secretary of state's
27	25		public Internet website a database containing information provided
28	26		by each authority responsible for giving notice of an election in
29	27		this state. The database must include the following information:
30	28		(1) the name of the authority;
31	29		(2) each office to be filled at the election;
32	30		(3) whether the office is elected at large or by
33	31		district; and
34	32		(4) the dates of the preceding and next election for
35	33		the office.
36		-	(b) The secretary of state shall adopt rules as necessary to
37		-	implement this section.
	34	+	(b) The secretary of state:
	35	+	(1) may solicit and accept gifts, grants, and
	36	+	donations from any public or private source for the creation and
	37	+	maintenance of the database; and
	38	+	(2) shall adopt rules as necessary to implement this
	39	+	section.
38	40		Sec. 31.018. INTERNET DATABASE FOR INCUMBENTS AND
39	41		CANDIDATES. (a) The secretary of state shall post on the secretary
40	42		of state's Internet website a database containing information about
41	43		each holder of and candidate for any elected office in this state.
42	44		(b) The database must include the following information
43	45		about a holder of an elected office:
44	46		(1) name;
45	47		(2) office title, including any district, place, or
46	48		position;
47	49		(3) if the office is elected at large or by district;
48	50		(4) date of the previous and next election for the
49	51		office;
50	52		(5) public mailing address;
51	53		(6) public telephone number, if available; and
52	54		(7) public e-mail address, if available.
53	55		(c) The database must include the following information
54	56		about a candidate for an elected office:
55	57		(1) name;
56	58		(2) office sought, including any district, place, or
57	59		position;
58	60		(3) if the office is elected at large or by district;
59	61		(4) date of the election;
60	62		(5) public mailing address;
61	63		(6) public telephone number, if available;
62	64		(7) public e-mail address, if available;
63	65		(8) name of the incumbent; and
64	66		(9) if the candidate has filed as a write-in
65	67		candidate.
66	68		(d) The authority with whom a declaration of candidacy is
67	69		filed, a state chair of a political party, or the presiding officer
68	70		of a political party's convention shall provide information about a
69	71		candidate or officeholder to the secretary of state.
70		-	(e) The secretary of state shall adopt rules as necessary to
71		-	implement this section.
72		-	SECTION 3. Section 141.032, Election Code, is amended by

	80	+	SECTION 4. Section 141.032, Election Code, is amended by
73	81		adding Subsection (h) to read as follows:
74	82		(h) The authority with whom the application is filed shall
75	83		provide the secretary of state with the candidate's information
76	84		required for the secretary of state's Internet website under
77	85		Section 31.018.
78		-	SECTION 4. This Act takes effect September 1, 2021.
