| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 4, Election Code, is amended by adding |
|---|
| 11 | 11 | | Section 4.009 to read as follows: |
|---|
| 12 | 12 | | Sec. 4.009. INTERNET POSTING. (a) Not later than the 21st |
|---|
| 13 | 13 | | day before election day, a county that holds or provides election |
|---|
| 14 | 14 | | services for an election and maintains an Internet website shall |
|---|
| 15 | 15 | | post on its public Internet website for an election administered by |
|---|
| 16 | 16 | | the county: |
|---|
| 17 | 17 | | (1) the date of the election; |
|---|
| 18 | 18 | | (2) the location of each polling place; |
|---|
| 19 | 19 | | (3) each candidate for an elected office on the |
|---|
| 20 | 20 | | ballot; and |
|---|
| 21 | 21 | | (4) each measure on the ballot. |
|---|
| 22 | 22 | | (b) Not later than the 21st day before election day, a city |
|---|
| 23 | 23 | | or independent school district that holds an election and maintains |
|---|
| 24 | 24 | | an Internet website shall post on the public Internet website for |
|---|
| 25 | 25 | | the city or independent school district, as applicable: |
|---|
| 26 | 26 | | (1) the date of the next election; |
|---|
| 27 | 27 | | (2) the location of each polling place; |
|---|
| 28 | 28 | | (3) each candidate for an elected office on the |
|---|
| 29 | 29 | | ballot; and |
|---|
| 30 | 30 | | (4) each measure on the ballot. |

| 31 | 31 | | SECTION 2. Subchapter A, Chapter 65, Election Code, is |

| 32 | 32 | | amended by adding Section 65.016 to read as follows: |

| 33 | 33 | | Sec. 65.016. INTERNET POSTING OF ELECTION RESULTS. (a) A |

| 35 | 35 | | maintains an Internet website shall post on its public Internet |

|---|
| 37 | 37 | | (1) the results of each election; |

| 38 | 38 | | (2) the total number of votes cast; |
|---|
| 39 | 39 | | (3) the total number of votes cast for each candidate |

| 40 | 40 | | or for or against each measure; |
|---|
| 41 | 41 | | (4) the total number of votes cast by personal |
|---|
| 42 | 42 | | appearance on election day; |
|---|
| 43 | 43 | | (5) the total number of votes cast by personal |
|---|
| 44 | 44 | | appearance or mail during the early voting period; and |
|---|
| 45 | 45 | | (6) the total number of counted and uncounted |
|---|
| 46 | 46 | | provisional ballots cast. |

| 47 | 47 | | (b) A city or independent school district that holds an |

| 48 | 48 | | election and maintains an Internet website shall post on the public |
|---|
| 49 | 49 | | Internet website for the city or independent school district, as |
|---|
| 50 | 50 | | applicable: |
|---|
| 51 | 51 | | (1) the results of each election; |
|---|
| 52 | 52 | | (2) the total number of votes cast; |
|---|
| 53 | 53 | | (3) the total number of votes cast for each candidate |
|---|
| 54 | 54 | | or for or against each measure; |
|---|
| 55 | 55 | | (4) the total number of votes cast by personal |
|---|
| 56 | 56 | | appearance on election day; |
|---|
| 57 | 57 | | (5) the total number of votes cast by personal |
|---|
| 58 | 58 | | appearance or mail during the early voting period; and |
|---|
| 59 | 59 | | (6) the total number of counted and uncounted |

| 60 | 60 | | provisional ballots cast. |

| 61 | 61 | | (c) The information described by Subsections (a) and (b) |

| 63 | 63 | | (1) clearly labeled in plain language; |
|---|
| 64 | 64 | | (2) provided as soon as practicable after the |
|---|
| 65 | 65 | | election; |
|---|
| 66 | 66 | | (3) accessible without having to make more than two |
|---|
| 67 | 67 | | selections or view more than two network locations after accessing |
|---|
| 68 | 68 | | the Internet website home page of the county, city, or district, as |
|---|
| 69 | 69 | | applicable, for the most recent election; and |
|---|
| 70 | 70 | | (4) accessible without having to make more than four |
|---|
| 71 | 71 | | selections or view more than four network locations after accessing |
|---|
| 72 | 72 | | the Internet website home page of the county, city, or district, as |
|---|
| 73 | 73 | | applicable, for a previous election. |
|---|
| 74 | 74 | | SECTION 3. The changes in law made by this Act apply only to |
|---|
| 75 | 75 | | an election ordered on or after the effective date of this Act. An |
|---|
| 76 | 76 | | election ordered before the effective date of this Act is governed |
|---|
| 77 | 77 | | by the law in effect when the election was ordered, and the former |
|---|
| 78 | 78 | | law is continued in effect for that purpose. |
|---|
| 79 | 79 | | SECTION 4. This Act takes effect September 1, 2021. |
