66 AN ACT
77 relating to a county, city, or independent school district posting
88 certain election information on an Internet website.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 4, Election Code, is amended by adding
1111 Section 4.009 to read as follows:
1212 Sec. 4.009. INTERNET POSTING. (a) Not later than the 21st
1313 day before election day, a county that holds or provides election
1414 services for an election and maintains an Internet website shall
1515 post on its public Internet website for an election administered by
1616 the county:
1717 (1) the date of the election;
1818 (2) the location of each polling place;
1919 (3) each candidate for an elected office on the
2020 ballot; and
2121 (4) each measure on the ballot.
2222 (b) Not later than the 21st day before election day, a city
2323 or independent school district that holds an election and maintains
2424 an Internet website shall post on the public Internet website for
2525 the city or independent school district, as applicable:
2626 (1) the date of the next election;
2727 (2) the location of each polling place;
2828 (3) each candidate for an elected office on the
2929 ballot; and
3030 (4) each measure on the ballot.
3131 SECTION 2. Subchapter A, Chapter 65, Election Code, is
3232 amended by adding Section 65.016 to read as follows:
3333 Sec. 65.016. INTERNET POSTING OF ELECTION RESULTS. (a) A
3434 county that holds or provides election services for an election and
3535 maintains an Internet website shall post on its public Internet
3636 website for an election administered by the county:
3737 (1) the results of each election;
3838 (2) the total number of votes cast;
3939 (3) the total number of votes cast for each candidate
4040 or for or against each measure;
4141 (4) the total number of votes cast by personal
4242 appearance on election day;
4343 (5) the total number of votes cast by personal
4444 appearance or mail during the early voting period; and
4545 (6) the total number of counted and uncounted
4646 provisional ballots cast.
4747 (b) A city or independent school district that holds an
4848 election and maintains an Internet website shall post on the public
4949 Internet website for the city or independent school district, as
5050 applicable:
5151 (1) the results of each election;
5252 (2) the total number of votes cast;
5353 (3) the total number of votes cast for each candidate
5454 or for or against each measure;
5555 (4) the total number of votes cast by personal
5656 appearance on election day;
5757 (5) the total number of votes cast by personal
5858 appearance or mail during the early voting period; and
5959 (6) the total number of counted and uncounted
6060 provisional ballots cast.
6161 (c) The information described by Subsections (a) and (b)
6262 must be:
6363 (1) clearly labeled in plain language;
6464 (2) provided as soon as practicable after the
6565 election;
6666 (3) accessible without having to make more than two
6767 selections or view more than two network locations after accessing
6868 the Internet website home page of the county, city, or district, as
6969 applicable, for the most recent election; and
7070 (4) accessible without having to make more than four
7171 selections or view more than four network locations after accessing
7272 the Internet website home page of the county, city, or district, as
7373 applicable, for a previous election.
7474 SECTION 3. The changes in law made by this Act apply only to
7575 an election ordered on or after the effective date of this Act. An
7676 election ordered before the effective date of this Act is governed
7777 by the law in effect when the election was ordered, and the former
7878 law is continued in effect for that purpose.
7979 SECTION 4. This Act takes effect September 1, 2021.
