66 AN ACT
77 relating to the storage and recovery of water in a portion of the
88 Edwards Aquifer.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1.44(e), Chapter 626, Acts of the 73rd
1111 Legislature, Regular Session, 1993, is amended to read as follows:
1212 (e) The authority may contract for injection or artificial
1313 recharge under this section only if provision is made for
1414 protecting and maintaining the quality of groundwater in the
1515 receiving part of the aquifer, and:
1616 (1) the water used for artificial recharge is
1717 groundwater withdrawn from the aquifer;
1818 (2) the water is recharged through a natural recharge
1919 feature; or
2020 (3) the water is injected by the Alliance Regional
2121 Water Authority, the Canyon Regional Water Authority, or a
2222 municipally owned utility owned by the City of Buda, the City of
2323 Kyle, the City of New Braunfels, or the City of San Marcos and:
2424 (A) the water has a total dissolved solids
2525 concentration of less than 1,500 milligrams per liter and is not
2626 domestic wastewater, municipal wastewater, or reclaimed water as
2727 those terms are defined by 30 T.A.C. Chapter 210, effective October
2828 31, 2018;
2929 (B) the injection well terminates in a portion of
3030 the aquifer that contains groundwater with a total dissolved solids
3131 concentration of more than 5,000 milligrams per liter; and
3232 (C) if the water injected is state water, the
3333 political subdivision or utility has a water right or contract for
3434 use of the water that does not prohibit use of the water in an
3535 aquifer storage and recovery project.
3636 SECTION 2. This Act takes effect September 1, 2021.
