| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1.44(e), Chapter 626, Acts of the 73rd |
|---|
| 11 | 11 | | Legislature, Regular Session, 1993, is amended to read as follows: |
|---|
| 12 | 12 | | (e) The authority may contract for injection or artificial |
|---|
| 13 | 13 | | recharge under this section only if provision is made for |
|---|
| 14 | 14 | | protecting and maintaining the quality of groundwater in the |
|---|
| 15 | 15 | | receiving part of the aquifer, and: |
|---|
| 16 | 16 | | (1) the water used for artificial recharge is |
|---|
| 17 | 17 | | groundwater withdrawn from the aquifer; |
|---|
| 18 | 18 | | (2) the water is recharged through a natural recharge |
|---|
| 19 | 19 | | feature; or |
|---|
| 20 | 20 | | (3) the water is injected by the Alliance Regional |
|---|
| 21 | 21 | | Water Authority, the Canyon Regional Water Authority, or a |
|---|
| 22 | 22 | | municipally owned utility owned by the City of Buda, the City of |
|---|
| 23 | 23 | | Kyle, the City of New Braunfels, or the City of San Marcos and: |
|---|
| 24 | 24 | | (A) the water has a total dissolved solids |
|---|
| 25 | 25 | | concentration of less than 1,500 milligrams per liter and is not |
|---|
| 26 | 26 | | domestic wastewater, municipal wastewater, or reclaimed water as |
|---|
| 27 | 27 | | those terms are defined by 30 T.A.C. Chapter 210, effective October |
|---|
| 28 | 28 | | 31, 2018; |
|---|
| 29 | 29 | | (B) the injection well terminates in a portion of |
|---|
| 30 | 30 | | the aquifer that contains groundwater with a total dissolved solids |
|---|
| 31 | 31 | | concentration of more than 5,000 milligrams per liter; and |
|---|
| 32 | 32 | | (C) if the water injected is state water, the |
|---|
| 33 | 33 | | political subdivision or utility has a water right or contract for |
|---|
| 34 | 34 | | use of the water that does not prohibit use of the water in an |
|---|
| 35 | 35 | | aquifer storage and recovery project. |
|---|
| 36 | 36 | | SECTION 2. This Act takes effect September 1, 2021. |
