7 | 7 | | relating to requiring public schools to use the wet bulb globe |

8 | 8 | | temperature to determine whether conditions are unsatisfactory for |

9 | 9 | | student outdoor activities due to severe heat. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter A, Chapter 38, Education Code, is |
---|
12 | 12 | | amended by adding Section 38.020 to read as follows: |
---|
13 | 13 | | Sec. 38.020. USE OF WET BULB GLOBE TEMPERATURE FOR SEVERE |
---|
14 | 14 | | HEAT DETERMINATIONS. (a) In this section, "wet bulb globe |
---|
15 | 15 | | temperature" means a comprehensive measurement of environmental |
---|
16 | 16 | | conditions that accounts for ambient temperature, relative |
---|
17 | 17 | | humidity, wind, and solar radiation. |
---|
18 | 18 | | (b) Each school district and open-enrollment charter school |
---|
19 | 19 | | shall refer to the wet bulb globe temperature in determining |
---|
20 | 20 | | satisfactory or unsatisfactory conditions for outdoor activities, |
---|
21 | 21 | | including: |
---|
22 | 22 | | (1) athletic activities; |
---|
23 | 23 | | (2) recess; |
---|
24 | 24 | | (3) extracurricular activities conducted outdoors; |
---|
25 | 25 | | and |
---|
26 | 26 | | (4) any other related activities. |
---|
27 | 27 | | (c) This section does not: |
---|
28 | 28 | | (1) waive any immunity from liability of a school |
---|
29 | 29 | | district or open-enrollment charter school or of district or |
---|
30 | 30 | | charter school officers or employees; or |
---|
31 | 31 | | (2) create any liability for a cause of action against |
---|
32 | 32 | | a school district or open-enrollment charter school or against |
---|
33 | 33 | | district or charter school officers or employees. |
---|
34 | 34 | | SECTION 2. This Act applies beginning with the 2021-2022 |
---|
35 | 35 | | school year. |
---|
36 | 36 | | SECTION 3. This Act takes effect immediately if it receives |
---|
37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
---|
38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
---|
40 | 40 | | Act takes effect September 1, 2021. |
