66 AN ACT
77 relating to requiring public schools to use the wet bulb globe
88 temperature to determine whether conditions are unsatisfactory for
99 student outdoor activities due to severe heat.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1212 amended by adding Section 38.020 to read as follows:
1313 Sec. 38.020. USE OF WET BULB GLOBE TEMPERATURE FOR SEVERE
1414 HEAT DETERMINATIONS. (a) In this section, "wet bulb globe
1515 temperature" means a comprehensive measurement of environmental
1616 conditions that accounts for ambient temperature, relative
1717 humidity, wind, and solar radiation.
1818 (b) Each school district and open-enrollment charter school
1919 shall refer to the wet bulb globe temperature in determining
2020 satisfactory or unsatisfactory conditions for outdoor activities,
2121 including:
2222 (1) athletic activities;
2323 (2) recess;
2424 (3) extracurricular activities conducted outdoors;
2525 and
2626 (4) any other related activities.
2727 (c) This section does not:
2828 (1) waive any immunity from liability of a school
2929 district or open-enrollment charter school or of district or
3030 charter school officers or employees; or
3131 (2) create any liability for a cause of action against
3232 a school district or open-enrollment charter school or against
3333 district or charter school officers or employees.
3434 SECTION 2. This Act applies beginning with the 2021-2022
3535 school year.
3636 SECTION 3. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2021.
