55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to notice to elected officials of a widespread power,
88 water, or natural gas outage or emergency.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 31, Utilities Code, is
1111 amended by adding Section 31.006 to read as follows:
1212 Sec. 31.006. NOTICE TO ELECTED OFFICIALS REQUIRED. As soon
1313 as practicable after an electric utility, municipally owned
1414 utility, or electric cooperative experiences a widespread power
1515 outage or a widespread electric service emergency, the utility or
1616 cooperative shall notify by telephone and e-mail each:
1717 (1) United States senator who represents this state;
1818 (2) member of the United States House of
1919 Representatives who represents a district affected by the
2020 disruption or emergency;
2121 (3) statewide elected official;
2222 (4) member of the legislature who represents a
2323 district affected by the disruption or emergency;
2424 (5) elected official of a county government who
2525 represents an area affected by the disruption or emergency; and
2626 (6) elected official of a municipal government who
2727 represents an area affected by the disruption or emergency.
2828 SECTION 2. Subchapter A, Chapter 104, Utilities Code, is
2929 amended by adding Section 104.009 to read as follows:
3030 Sec. 104.009. NOTICE TO ELECTED OFFICIALS REQUIRED. As
3131 soon as practicable after a gas utility, municipally owned utility,
3232 or electric cooperative experiences a widespread natural gas
3333 shortage or a widespread natural gas service emergency, the utility
3434 or cooperative shall notify by telephone and e-mail each:
3535 (1) United States senator who represents this state;
3636 (2) member of the United States House of
3737 Representatives who represents a district affected by the
3838 disruption or emergency;
3939 (3) statewide elected official;
4040 (4) member of the legislature who represents a
4141 district affected by the disruption or emergency;
4242 (5) elected official of a county government who
4343 represents an area affected by the disruption or emergency; and
4444 (6) elected official of a municipal government who
4545 represents an area affected by the disruption or emergency.
4646 SECTION 3. Subchapter E, Chapter 13, Water Code, is amended
4747 by adding Section 13.1397 to read as follows:
4848 Sec. 13.1397. NOTICE TO ELECTED OFFICIALS REQUIRED. As
4949 soon as practicable after a retail public utility experiences a
5050 widespread water service outage or a widespread water service
5151 emergency, the utility shall notify by telephone and e-mail each:
5252 (1) United States senator who represents this state;
5353 (2) member of the United States House of
5454 Representatives who represents a district affected by the
5555 disruption or emergency;
5656 (3) statewide elected official;
5757 (4) member of the legislature who represents a
5858 district affected by the disruption or emergency;
5959 (5) elected official of a county government who
6060 represents an area affected by the disruption or emergency; and
6161 (6) elected official of a municipal government who
6262 represents an area affected by the disruption or emergency.
6363 SECTION 4. This Act takes effect September 1, 2021.
