| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 522.023(b) and (d), Transportation |
|---|
| 11 | 11 | | Code, are amended to read as follows: |
|---|
| 12 | 12 | | (b) Except as provided by Subsection (d), the [The] |
|---|
| 13 | 13 | | knowledge test must be conducted by the department. The department |
|---|
| 14 | 14 | | shall provide each applicant who has a reading impairment an |
|---|
| 15 | 15 | | opportunity to take the knowledge test orally or, at the |
|---|
| 16 | 16 | | applicant's option, the applicant may have the questions read to |
|---|
| 17 | 17 | | the applicant and may answer in writing. |
|---|
| 18 | 18 | | (d) The department may authorize a person, including an |
|---|
| 19 | 19 | | agency of this or another state, an employer, a private driver |
|---|
| 20 | 20 | | training facility or other private institution, or a department, |
|---|
| 21 | 21 | | agency, or instrumentality of local government, to: |
|---|
| 22 | 22 | | (1) administer the skills test specified by this |
|---|
| 23 | 23 | | section if: |
|---|
| 24 | 24 | | (A) [(1)] the test is the same that would be |
|---|
| 25 | 25 | | administered by the department; and |
|---|
| 26 | 26 | | (B) [(2)] the person has entered into an |
|---|
| 27 | 27 | | agreement with the department that complies with 49 C.F.R. Section |
|---|
| 28 | 28 | | 383.75; or |
|---|
| 29 | 29 | | (2) administer the knowledge test specified by this |
|---|
| 30 | 30 | | section if: |
|---|
| 31 | 31 | | (A) the test is the same that would be |
|---|
| 32 | 32 | | administered by the department; |
|---|
| 33 | 33 | | (B) the administration of the test is authorized |
|---|
| 34 | 34 | | by federal law; and |
|---|
| 35 | 35 | | (C) the person provides each applicant who has a |
|---|
| 36 | 36 | | reading impairment an opportunity to, at the applicant's option: |
|---|
| 37 | 37 | | (i) take the knowledge test orally; or |
|---|
| 38 | 38 | | (ii) have the questions read to the |
|---|
| 39 | 39 | | applicant and answer in writing. |

| 40 | 40 | | SECTION 2. This Act takes effect September 1, 2021. |
