66 AN ACT
77 relating to the knowledge test required for a commercial driver's
88 license.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 522.023(b) and (d), Transportation
1111 Code, are amended to read as follows:
1212 (b) Except as provided by Subsection (d), the [The]
1313 knowledge test must be conducted by the department. The department
1414 shall provide each applicant who has a reading impairment an
1515 opportunity to take the knowledge test orally or, at the
1616 applicant's option, the applicant may have the questions read to
1717 the applicant and may answer in writing.
1818 (d) The department may authorize a person, including an
1919 agency of this or another state, an employer, a private driver
2020 training facility or other private institution, or a department,
2121 agency, or instrumentality of local government, to:
2222 (1) administer the skills test specified by this
2323 section if:
2424 (A) [(1)] the test is the same that would be
2525 administered by the department; and
2626 (B) [(2)] the person has entered into an
2727 agreement with the department that complies with 49 C.F.R. Section
2828 383.75; or
2929 (2) administer the knowledge test specified by this
3030 section if:
3131 (A) the test is the same that would be
3232 administered by the department;
3333 (B) the administration of the test is authorized
3434 by federal law; and
3535 (C) the person provides each applicant who has a
3636 reading impairment an opportunity to, at the applicant's option:
3737 (i) take the knowledge test orally; or
3838 (ii) have the questions read to the
3939 applicant and answer in writing.
4040 SECTION 2. This Act takes effect September 1, 2021.
