55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of the economic inclusion and
88 diversification task force.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. DEFINITIONS. In this Act:
1111 (1) "Economic development incentive" means a monetary
1212 incentive or tax incentive, as those terms are defined by Section
1313 490G.001, Government Code.
1414 (2) "Task force" means the economic inclusion and
1515 diversification task force established under this Act.
1616 SECTION 2. TASK FORCE. (a) The economic inclusion and
1717 diversification task force is established to study the use and
1818 effectiveness of economic development incentives awarded to
1919 businesses by this state and to offer recommendations on how this
2020 state can award economic development incentives in a more effective
2121 manner to ensure economic diversification, inclusive development,
2222 and investment in the residents and communities of this state.
2323 (b) The task force is composed of nine members as follows:
2424 (1) the chair of the senate natural resources and
2525 economic development committee;
2626 (2) the chair of the house international relations and
2727 economic development committee; and
2828 (3) the following members appointed by the governor:
2929 (A) four representatives of business and
3030 industry, including one member who is a representative of small
3131 businesses;
3232 (B) two members who are economic development
3333 practitioners; and
3434 (C) an economist from an institution of higher
3535 education.
3636 (c) In making appointments to the task force, the governor
3737 shall attempt to appoint persons who represent the gender
3838 composition, minority populations, and geographic regions of this
3939 state.
4040 (d) A task force member is not entitled to compensation for
4141 service on the task force but is entitled to reimbursement for
4242 actual and necessary expenses incurred in performing task force
4343 duties.
4444 (e) The members of the task force shall elect a presiding
4545 officer from among the membership.
4646 (f) The task force shall meet at least quarterly at the call
4747 of the presiding officer.
4848 (g) Notwithstanding Chapter 551, Government Code, or any
4949 other law, the task force may meet by telephone conference call,
5050 videoconference, or other similar telecommunication method. A
5151 meeting held by telephone conference call, videoconference, or
5252 other similar telecommunication method is subject to the
5353 requirements of Sections 551.125(c), (d), (e), and (f), Government
5454 Code.
5555 SECTION 3. DUTIES OF TASK FORCE. The task force shall:
5656 (1) study and make recommendations on whether in the
5757 next two fiscal bienniums, this state should prioritize the
5858 awarding of economic development incentives to:
5959 (A) Texas-based businesses seeking to expand
6060 their operations within the state;
6161 (B) out-of-state businesses that bring value to
6262 statewide industry supply chains and want to relocate to this
6363 state;
6464 (C) businesses making investments in upskilling
6565 their workforce;
6666 (D) businesses in new industries; or
6767 (E) businesses making investments in new
6868 technologies;
6969 (2) evaluate statewide industry supply chains for
7070 potential areas of investment;
7171 (3) develop a plan to support business enterprises
7272 located in this state by awarding incentives for investing in the
7373 technical support and workforce training needed to scale their
7474 enterprises and potentially reach global markets; and
7575 (4) reach out to universities and junior colleges,
7676 including junior colleges in rural areas of this state, to
7777 encourage their collaboration with businesses in their community
7878 for economic development and diversification purposes.
7979 SECTION 4. REPORT. Not later than December 1, 2022, the
8080 task force shall prepare and submit a written report on the results
8181 of the study and recommendations of the task force to the governor,
8282 lieutenant governor, speaker of the house of representatives, and
8383 presiding officer of each standing committee of the senate and the
8484 house of representatives with primary jurisdiction over state
8585 finance matters.
8686 SECTION 5. ABOLISHMENT OF TASK FORCE; EXPIRATION OF ACT.
8787 The task force is abolished and this Act expires September 1, 2023.
8888 SECTION 6. EFFECTIVE DATE. This Act takes effect
8989 immediately if it receives a vote of two-thirds of all the members
9090 elected to each house, as provided by Section 39, Article III, Texas
9191 Constitution. If this Act does not receive the vote necessary for
9292 immediate effect, this Act takes effect September 1, 2021.
