55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of a task force to study factors
88 contributing to disproportionate COVID-19 outcomes.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. DEFINITIONS. In this Act:
1111 (1) "COVID-19" means the 2019 novel coronavirus
1212 disease.
1313 (2) "Executive commissioner" means the executive
1414 commissioner of the Health and Human Services Commission.
1515 (3) "Task force" means the task force established
1616 under Section 2 of this Act.
1717 SECTION 2. ESTABLISHMENT OF TASK FORCE. The executive
1818 commissioner shall establish a task force to:
1919 (1) identify and evaluate factors that contribute to
2020 the disproportionate development of severe illness,
2121 hospitalization, and death due to COVID-19 infection among racial
2222 and ethnic minorities;
2323 (2) assess this state's data collection practices
2424 related to COVID-19 testing and vaccination and the rates of
2525 hospitalization and death for people infected with COVID-19;
2626 (3) identify and determine the manner in which the
2727 factors identified in Subdivision (1) of this section affect
2828 population health; and
2929 (4) make recommendations for state pandemic response
3030 strategies and public health policy, including recommendations for
3131 improvements for this state's data collection, virus testing, and
3232 immunization strategies.
3333 SECTION 3. COMPOSITION OF TASK FORCE. (a) The task force
3434 is composed of 21 members as follows:
3535 (1) one member with relevant expertise, appointed by
3636 the governor;
3737 (2) two members with relevant expertise, appointed by
3838 the lieutenant governor;
3939 (3) two members with relevant expertise, appointed by
4040 the speaker of the house of representatives;
4141 (4) the chair of the Texas Hospital Association or the
4242 chair's designee;
4343 (5) the president of the Texas Medical Association or
4444 the president's designee;
4545 (6) the president of the Texas Nurses Association or
4646 the president's designee; and
4747 (7) 13 members appointed by the executive
4848 commissioner, including:
4949 (A) one member who is a licensed physician
5050 specializing in cardiology;
5151 (B) one member who is a licensed physician
5252 specializing in pulmonology;
5353 (C) one member who represents a hospital located
5454 in a rural area of this state;
5555 (D) one member who represents a hospital located
5656 in a county with a population of at least four million;
5757 (E) one member who represents a hospital located
5858 in an urban county with a population of less than four million;
5959 (F) one member who represents a public hospital;
6060 (G) one member who represents a private hospital;
6161 (H) two members who represent unaffiliated
6262 nonprofit community health organizations focused on reducing
6363 racial and ethnic health disparities;
6464 (I) one member who represents a community health
6565 center;
6666 (J) one member who is an epidemiologist;
6767 (K) one member who is a statistician; and
6868 (L) one member who is a public health expert.
6969 (b) The executive commissioner shall appoint a presiding
7070 officer of the task force from among the members of the task force.
7171 (c) The executive commissioner may fill any vacancy that
7272 occurs on the task force and may appoint additional members as
7373 needed.
7474 SECTION 4. APPOINTMENT OF MEMBERS. Not later than November
7575 1, 2021, the governor, lieutenant governor, speaker of the house of
7676 representatives, and executive commissioner shall appoint members
7777 to the task force.
7878 SECTION 5. REPORT. Not later than September 1, 2022, the
7979 task force shall prepare and submit to the governor, the lieutenant
8080 governor, the speaker of the house of representatives, and the
8181 members of the legislature a written report on its findings and
8282 recommendations, including legislative recommendations.
8383 SECTION 6. ABOLISHMENT AND EXPIRATION. The task force is
8484 abolished and this Act expires September 1, 2023.
8585 SECTION 7. EFFECTIVE DATE. This Act takes effect September
8686 1, 2021.
