7 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 16 | | SECTION 1. Section 771.001, Health and Safety Code, is |
---|
9 | 17 | | amended by adding Subdivisions (5-a) and (5-b) and amending |
---|
10 | 18 | | Subdivision (6) to read as follows: |
---|
11 | 19 | | (5-a) "Next generation 9-1-1 service" has the meaning |
---|
12 | 20 | | assigned by 47 U.S.C. Section 942. |
---|
13 | 21 | | (5-b) "Next generation 9-1-1 service fund" means the |
---|
14 | 22 | | next generation 9-1-1 service fund established under Section |
---|
15 | 23 | | 771.0713. |
---|
16 | 24 | | (6) "9-1-1 service" means a communications service |
---|
17 | 25 | | that connects users to a public safety answering point through a |
---|
18 | 26 | | 9-1-1 system. The term includes next generation 9-1-1 service. |
---|
19 | 27 | | SECTION 2. Section 771.059, Health and Safety Code, is |
---|
20 | 28 | | amended to read as follows: |
---|
21 | 29 | | Sec. 771.059. TARGET DATE [DEADLINE] FOR STATEWIDE NEXT |
---|
22 | 30 | | GENERATION 9-1-1 SERVICE. Before September 1, 2025 [1995], all |
---|
23 | 31 | | parts of the state must be covered by next generation 9-1-1 service. |
---|
24 | 32 | | SECTION 3. Subchapter D, Chapter 771, Health and Safety |
---|
25 | 33 | | Code, is amended by adding Section 771.0713 to read as follows: |
---|
26 | 34 | | Sec. 771.0713. NEXT GENERATION 9-1-1 SERVICE FUND. (a) The |
---|
27 | 35 | | next generation 9-1-1 service fund is created as a fund in the state |
---|
28 | 36 | | treasury outside the general revenue fund. |
---|
29 | 37 | | (b) Notwithstanding any other law and except as provided by |
---|
30 | 38 | | federal law, the comptroller shall transfer to the credit of the |
---|
31 | 39 | | next generation 9-1-1 service fund any amount available from |
---|
32 | 40 | | federal money provided to this state from the Coronavirus State and |
---|
33 | 41 | | Local Fiscal Recovery Funds under Section 9901 of the American |
---|
34 | 42 | | Rescue Plan Act of 2021 (Pub. L. No. 117-2) or from any other |
---|
35 | 43 | | federal governmental source for purposes of this chapter. The |
---|
36 | 44 | | comptroller shall transfer the money as soon as practicable |
---|
37 | 45 | | following the receipt by this state of a sufficient amount of |
---|
38 | 46 | | federal money for the transfer. |
---|
39 | 47 | | (c) Money deposited to the credit of the next generation |
---|
40 | 48 | | 9-1-1 service fund may be used only for the purpose of supporting |
---|
41 | 49 | | the deployment and reliable operation of next generation 9-1-1 |
---|
42 | 50 | | service, including the costs of equipment, operations, and |
---|
43 | 51 | | administration. Money in the fund may be distributed to only the |
---|
44 | 52 | | commission and emergency communication districts and must be used |
---|
45 | 53 | | in a manner that complies with federal law. |
---|
46 | 54 | | (d) Interest earned on money deposited to the credit of the |
---|
47 | 55 | | next generation 9-1-1 service fund is exempt from Section 404.071, |
---|
48 | 56 | | Government Code. Interest on money in the fund shall be retained in |
---|
49 | 57 | | the fund. |
---|
50 | 58 | | (e) The comptroller may issue guidelines for use by the |
---|
51 | 59 | | commission and emergency communication districts in implementing |
---|
52 | 60 | | this section. |
---|
53 | 61 | | (f) All money in the fund shall be distributed in accordance |
---|
54 | 62 | | with this section not later than December 31, 2022, and all money |
---|
55 | 63 | | distributed under this section shall be spent not later than |
---|
56 | 64 | | December 31, 2024, for the deployment and reliable operation of |
---|
57 | 65 | | next generation 9-1-1 service. |
---|
58 | 66 | | (g) This section expires September 1, 2025. |
---|
59 | 67 | | SECTION 4. Sections 771.0711(g) and (j), Health and Safety |
---|
60 | 68 | | Code, are repealed. |
---|
61 | 69 | | SECTION 5. Not later than December 1, 2021, the comptroller |
---|
62 | 70 | | of public accounts shall adopt rules necessary to establish and |
---|
63 | 71 | | administer the next generation 9-1-1 service fund established under |
---|
64 | 72 | | Section 771.0713, Health and Safety Code, as added by this Act. |
---|
65 | 73 | | SECTION 6. This Act takes effect September 1, 2021. |
