412 AN ACT
513 relating to next generation 9-1-1 service and the establishment of
614 a next generation 9-1-1 service fund.
715 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
816 SECTION 1. Section 771.001, Health and Safety Code, is
917 amended by adding Subdivisions (5-a) and (5-b) and amending
1018 Subdivision (6) to read as follows:
1119 (5-a) "Next generation 9-1-1 service" has the meaning
1220 assigned by 47 U.S.C. Section 942.
1321 (5-b) "Next generation 9-1-1 service fund" means the
1422 next generation 9-1-1 service fund established under Section
1523 771.0713.
1624 (6) "9-1-1 service" means a communications service
1725 that connects users to a public safety answering point through a
1826 9-1-1 system. The term includes next generation 9-1-1 service.
1927 SECTION 2. Section 771.059, Health and Safety Code, is
2028 amended to read as follows:
2129 Sec. 771.059. TARGET DATE [DEADLINE] FOR STATEWIDE NEXT
2230 GENERATION 9-1-1 SERVICE. Before September 1, 2025 [1995], all
2331 parts of the state must be covered by next generation 9-1-1 service.
2432 SECTION 3. Subchapter D, Chapter 771, Health and Safety
2533 Code, is amended by adding Section 771.0713 to read as follows:
2634 Sec. 771.0713. NEXT GENERATION 9-1-1 SERVICE FUND. (a) The
2735 next generation 9-1-1 service fund is created as a fund in the state
2836 treasury outside the general revenue fund.
2937 (b) Notwithstanding any other law and except as provided by
3038 federal law, the comptroller shall transfer to the credit of the
3139 next generation 9-1-1 service fund any amount available from
3240 federal money provided to this state from the Coronavirus State and
3341 Local Fiscal Recovery Funds under Section 9901 of the American
3442 Rescue Plan Act of 2021 (Pub. L. No. 117-2) or from any other
3543 federal governmental source for purposes of this chapter. The
3644 comptroller shall transfer the money as soon as practicable
3745 following the receipt by this state of a sufficient amount of
3846 federal money for the transfer.
3947 (c) Money deposited to the credit of the next generation
4048 9-1-1 service fund may be used only for the purpose of supporting
4149 the deployment and reliable operation of next generation 9-1-1
4250 service, including the costs of equipment, operations, and
4351 administration. Money in the fund may be distributed to only the
4452 commission and emergency communication districts and must be used
4553 in a manner that complies with federal law.
4654 (d) Interest earned on money deposited to the credit of the
4755 next generation 9-1-1 service fund is exempt from Section 404.071,
4856 Government Code. Interest on money in the fund shall be retained in
4957 the fund.
5058 (e) The comptroller may issue guidelines for use by the
5159 commission and emergency communication districts in implementing
5260 this section.
5361 (f) All money in the fund shall be distributed in accordance
5462 with this section not later than December 31, 2022, and all money
5563 distributed under this section shall be spent not later than
5664 December 31, 2024, for the deployment and reliable operation of
5765 next generation 9-1-1 service.
5866 (g) This section expires September 1, 2025.
5967 SECTION 4. Sections 771.0711(g) and (j), Health and Safety
6068 Code, are repealed.
6169 SECTION 5. Not later than December 1, 2021, the comptroller
6270 of public accounts shall adopt rules necessary to establish and
6371 administer the next generation 9-1-1 service fund established under
6472 Section 771.0713, Health and Safety Code, as added by this Act.
6573 SECTION 6. This Act takes effect September 1, 2021.
