| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 38.001, Civil Practice and Remedies | |
| 10 | 10 | Code, is amended to read as follows: | |
| 11 | 11 | Sec. 38.001. RECOVERY OF ATTORNEY'S FEES. (a) In this | |
| 12 | 12 | section, "organization" has the meaning assigned by Section 1.002, | |
| 13 | 13 | Business Organizations Code. | |
| 14 | 14 | (b) A person may recover reasonable attorney's fees from an | |
| 15 | 15 | individual or corporationorganization, in addition to the amount | |
| 16 | 16 | of a valid claim and costs, if the claim is for: | |
| 17 | 17 | (1) rendered services; | |
| 18 | 18 | (2) performed labor; | |
| 19 | 19 | (3) furnished material; | |
| 20 | 20 | (4) freight or express overcharges; | |
| 21 | 21 | (5) lost or damaged freight or express; | |
| 22 | 22 | (6) killed or injured stock; | |
| 23 | 23 | (7) a sworn account; or | |
| 24 | 24 | (8) an oral or written contract. | |
| 25 | 25 | SECTION 2. The change in law made by this Act applies only | |
| 26 | 26 | to an award of attorney's fees in an action commenced on or after | |
| 27 | 27 | the effective date of this Act. An award of attorney's fees in an | |
| 28 | 28 | action commenced before the effective date of this Act is governed | |
| 29 | 29 | by the law applicable to the award immediately before the effective | |
| 30 | 30 | date of this Act, and that law is continued in effect for that | |
| 31 | 31 | purpose. | |
| 32 | 32 | SECTION 3. This Act takes effect September 1, 2021. |
