129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1310 SECTION 1. Section 502.198(a), Transportation Code, is
1411 amended to read as follows:
1512 (a) Except as provided by Sections 502.058, 502.060,
16- 502.1911, 502.192, 502.356, [and] 502.357, and 502.360 and
17- Subchapter H, this section applies to all fees collected by a county
13+ 502.1911, 502.192, 502.1981, 502.356, and 502.357 and Subchapter H,
14+ this section applies to all fees collected by a county
1815 assessor-collector under this chapter.
19- SECTION 2. Subchapter G, Chapter 502, Transportation Code,
20- is amended by adding Section 502.360 to read as follows:
21- Sec. 502.360. ADDITIONAL FEE FOR MOTOR VEHICLE FOR WHICH
22- REGISTRATION IS APPLIED FOR BY MOTOR VEHICLE DEALER. (a) In
23- addition to the applicable registration fee charged under this
24- chapter, an additional fee of $25 per registration year is imposed
25- on the registration of a motor vehicle for which registration is
26- applied for under Section 501.0234.
27- (b) Notwithstanding any other law, an additional fee
28- authorized by a county under Subchapter H, including an additional
29- fee authorized under Section 502.401, 502.402, or 502.403, may not
30- be imposed on a motor vehicle described by Subsection (a).
31- (c) The fee imposed under this section shall be:
32- (1) collected for a motor vehicle when other fees
33- imposed under this chapter are collected; and
34- (2) deposited to the credit of the county road and
35- bridge fund of the county in which the owner of the motor vehicle
36- described by Subsection (a) is domiciled, provided that if the
37- county in which the owner of the motor vehicle described by
38- Subsection (a) is domiciled imposes an additional fee under
39- Subchapter H, an amount equal to the additional fee imposed under
40- that subchapter shall be deposited, remitted, and used, as
41- applicable, in accordance with the provisions of that subchapter
42- authorizing the additional fee.
43- (d) This subsection applies only to a motor vehicle for
44- which registration is applied for under Section 501.0234 in a
45- county other than the county in which the owner is domiciled. Each
46- Tuesday, a county assessor-collector shall send each fee imposed
47- under this section to the county in which the owner of the motor
48- vehicle described by this subsection is domiciled.
49- (e) This section does not apply to the renewal of
50- registration of a motor vehicle described by Subsection (a).
51- (f) The department may adopt rules to administer this
52- section.
53- SECTION 3. This Act takes effect September 1, 2021.
16+ SECTION 2. Subchapter E, Chapter 502, Transportation Code,
17+ is amended by adding Section 502.1981 to read as follows:
18+ Sec. 502.1981. DISPOSITION OF CERTAIN FEES. (a) This
19+ subsection applies only to a vehicle for which registration is
20+ applied for under Section 501.0234 in the county in which the owner
21+ is domiciled. Each Tuesday, a county assessor-collector shall:
22+ (1) credit to the county road and bridge fund $25 of
23+ each fee collected during the preceding week for registration of a
24+ vehicle described by this subsection; and
25+ (2) send the remainder of the amount collected to the
26+ department for deposit to the credit of the state highway fund.
27+ (b) This subsection applies only to a vehicle for which
28+ registration is applied for under Section 501.0234 in a county
29+ other than the county in which the owner is domiciled. Each
30+ Tuesday, a county assessor-collector shall:
31+ (1) send $25 of each fee collected during the
32+ preceding week for registration of a vehicle described by this
33+ subsection to the county in which the owner of the vehicle is
34+ domiciled; and
35+ (2) dispose of the remainder of the amount collected
36+ in the manner provided by Section 502.198.
37+ (c) A county assessor-collector shall credit to the county
38+ road and bridge fund the amount received by the county under
39+ Subsection (b)(1).
40+ (d) This section does not apply to a fee collected for the
41+ renewal of registration of a vehicle described by Subsection (a) or
42+ (b).
43+ SECTION 3. Section 502.1983(a), Transportation Code, is
44+ amended to read as follows:
45+ (a) A county assessor-collector may:
46+ (1) deposit the fees subject to Section 502.198 or
47+ 502.1981(a) in an interest-bearing account or certificate in the
48+ county depository; and
49+ (2) send the fees to the department not later than the
50+ 34th day after the date the fees are due under Section 502.198 or
51+ 502.1981(a), as applicable.
52+ SECTION 4. Subchapter H, Chapter 502, Transportation Code,
53+ is amended by adding Section 502.4035 to read as follows:
54+ Sec. 502.4035. IMPOSITION OF OPTIONAL COUNTY FEE ON CERTAIN
55+ VEHICLES PROHIBITED. (a) Notwithstanding any other provision of
56+ this subchapter, an additional fee authorized by a county under
57+ this subchapter, including an additional fee authorized under
58+ Section 502.401, 502.402, or 502.403, may not be imposed on a
59+ vehicle for which registration is applied for under Section
60+ 501.0234.
61+ (b) This section does not apply to the renewal of
62+ registration of a vehicle described by Subsection (a).
63+ SECTION 5. This Act takes effect September 1, 2021.
