| 7 | 7 | | relating to an agreement between the Department of Public Safety |

| 8 | 8 | | and a county, municipality, or private vendor for the issuance of |
|---|
| 9 | 9 | | renewal and duplicate driver's licenses and other identification |
|---|
| 10 | 10 | | certificate services; increasing a fee. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 12 | 12 | | SECTION 1. Sections 521.009(a), (a-1), and (c), |
|---|
| 13 | 13 | | Transportation Code, are amended to read as follows: |
|---|
| 14 | 14 | | (a) The department may establish a program for the provision |
|---|
| 15 | 15 | | of renewal and duplicate driver's license, election identification |
|---|
| 16 | 16 | | certificate, and personal identification certificate services by |
|---|
| 17 | 17 | | [in] counties, [and] municipalities, and private vendors that enter |
|---|
| 18 | 18 | | into an agreement with the department under Subsection (a-1). |
|---|
| 19 | 19 | | (a-1) Under the program, the department may enter into an |
|---|
| 20 | 20 | | agreement with the commissioners court of a county, [or] the |
|---|
| 21 | 21 | | governing body of a municipality, or a private vendor to permit |
|---|
| 22 | 22 | | county, [or] municipal, or vendor employees to provide services at |
|---|
| 23 | 23 | | a county or municipal office or at a location determined by the |
|---|
| 24 | 24 | | vendor relating to the issuance of renewal and duplicate driver's |
|---|
| 25 | 25 | | licenses, election identification certificates, and personal |
|---|
| 26 | 26 | | identification certificates, including: |
|---|
| 27 | 27 | | (1) taking photographs; |
|---|
| 28 | 28 | | (2) administering vision tests; |
|---|
| 29 | 29 | | (3) updating a driver's license, election |
|---|
| 30 | 30 | | identification certificate, or personal identification certificate |
|---|
| 31 | 31 | | to change a name, address, or photograph; |
|---|
| 32 | 32 | | (4) distributing and collecting information relating |
|---|
| 33 | 33 | | to donations under Section 521.401; |
|---|
| 34 | 34 | | (5) collecting fees; and |
|---|
| 35 | 35 | | (6) performing other basic ministerial functions and |
|---|
| 36 | 36 | | tasks necessary to issue renewal and duplicate driver's licenses, |
|---|
| 37 | 37 | | election identification certificates, and personal identification |
|---|
| 38 | 38 | | certificates. |
|---|
| 39 | 39 | | (c) A participating county, [or] municipality, or private |
|---|
| 40 | 40 | | vendor must remit to the department for deposit as required by this |
|---|
| 41 | 41 | | chapter fees collected for the issuance of a renewal or duplicate |
|---|
| 42 | 42 | | driver's license or personal identification certificate. |
|---|
| 43 | 43 | | SECTION 2. Section 521.428, Transportation Code, is amended |
|---|
| 44 | 44 | | to read as follows: |
|---|
| 45 | 45 | | Sec. 521.428. COUNTY, [OR] MUNICIPAL, OR PRIVATE VENDOR |
|---|
| 46 | 46 | | FEE. A county, [or] municipality, or private vendor that provides |
|---|
| 47 | 47 | | services under an agreement described by Section 521.009 may |
|---|
| 48 | 48 | | collect an additional fee of up to $10 [$5] for each transaction |
|---|
| 49 | 49 | | provided that relates to driver's license and personal |
|---|
| 50 | 50 | | identification certificate services only. |
|---|
| 51 | 51 | | SECTION 3. This Act takes effect September 1, 2021. |
