55 AN ACT
66 relating to revocation of do-not-resuscitate orders for patients
77 admitted to a health care facility or hospital.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 166.205(a), (b), and (c), Health and
1010 Safety Code, are amended to read as follows:
1111 (a) A physician providing direct care to a patient for whom
1212 a DNR order is issued shall revoke the patient's DNR order if:
1313 (1) the advance directive on which the DNR order is
1414 based is revoked in accordance with this chapter; or
1515 (2) the patient or the individual whose direction or
1616 treatment decision was the basis for issuing the DNR order[, as
1717 applicable, the patient's agent under a medical power of attorney
1818 or the patient's legal guardian if the patient is incompetent:
1919 [(1) effectively revokes an advance directive, in
2020 accordance with Section 166.042, for which a DNR order is issued
2121 under Section 166.203(a); or
2222 [(2)] expresses to any person providing direct care to
2323 the patient a revocation of consent to or intent to revoke a DNR
2424 order issued under Section 166.203(a).
2525 (b) A person providing direct care to a patient under the
2626 supervision of a physician shall notify the physician of:
2727 (1) the revocation of the advance directive described
2828 by Subsection (a)(1); or
2929 (2) the request to revoke a DNR order under Subsection
3030 (a)(2) [(a)].
3131 (c) The [A patient's attending] physician who issued [may at
3232 any time revoke] a DNR order issued under Section 166.203(a)(2) may
3333 at any time revoke the DNR order.
3434 SECTION 2. This Act takes effect September 1, 2021.
