5 | 11 | | relating to the composition of and actions transferred by the |

6 | 12 | | judicial panel on multidistrict litigation. |

7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 14 | | SECTION 1. Section 74.161(a), Government Code, is amended |
---|
9 | 15 | | to read as follows: |
---|
10 | 16 | | (a) The judicial panel on multidistrict litigation consists |
---|
11 | 17 | | of five members designated from time to time by the [chief justice |
---|
12 | 18 | | of the] supreme court. The members of the panel must be active, |
---|
13 | 19 | | former, or retired court of appeals justices or active |
---|
14 | 20 | | administrative judges. |
---|
15 | 21 | | SECTION 2. Section 74.1625(a), Government Code, is amended |
---|
16 | 22 | | to read as follows: |
---|
17 | 23 | | (a) Notwithstanding any other law, the judicial panel on |
---|
18 | 24 | | multidistrict litigation may not transfer: |
---|
19 | 25 | | (1) an action brought by the consumer protection |
---|
20 | 26 | | division of the attorney general's office under Subchapter E, |
---|
21 | 27 | | Chapter 17, Business & Commerce Code[, except an action |
---|
22 | 28 | | specifically authorized by Section 17.50 of that code]; or |
---|
23 | 29 | | (2) an action brought under Chapter 36, Human |
---|
24 | 30 | | Resources Code. |
---|
25 | 31 | | SECTION 3. The changes in law made by this Act apply only to |
---|
26 | 32 | | an action commenced on or after the effective date of this Act. An |
---|
27 | 33 | | action commenced before the effective date of this Act is governed |
---|
28 | 34 | | by the law in effect immediately before the effective date of this |
---|
29 | 35 | | Act, and the former law is continued in effect for that purpose. |
---|
30 | 36 | | SECTION 4. This Act takes effect immediately if it receives |
---|
31 | 37 | | a vote of two-thirds of all the members elected to each house, as |
---|
32 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
33 | 39 | | Act does not receive the vote necessary for immediate effect, this |
---|
34 | 40 | | Act takes effect September 1, 2021. |
